CITY OF QUINCY, WASHINGTON ORDINANCE NO. 24-616 AN ORDINANCE OF THE CITY OF QUINCY, WASHINGTON AMENDING ORDINANCE NO. 465 TO PROVIDE FOR AN EXTENSION OF THE TERMINATION DATE FOR THE FRANCHISE AGREEMENT WITH PUBLIC UTILITY DISTRICT NO. 2 OF GRANT COUNTY. WHEREAS, Ordinance No. 465, which was adopted on July 2, 1974, grants Public Utility District No. 2 of Grant County (“GCPUD”) a franchise to operate and maintain an electrical distribution system in the City of Quincy, Washington for fifty years (“Franchise Agreement”); and WHEREAS, the Franchise Agreement is set to expire in July 2, 2024; and WHEREAS, GCPUD requested the City to extend the Franchise Agreement for two years with a new termination date of July 2, 2026, while a new Franchise Agreement is being negotiated; and WHEREAS, the City desires to extend the termination date of the Franchise Agreement as requested by the GCPUD; and WHEREAS, in compliance with RCW 35A.47.040, Ordinance No. 24-616 was introduced to the City Council at its regular meeting on June 4, 2024, and thereafter adopted at a regular meeting that occurred more than five days after the initial introduction of the Ordinance; and WHEREAS, Ordinance No. 24-616 was submitted to the City Attorney prior to the adoption. NOW, THEREFORE, the City Council of the City of Quincy, Washington do ordain as follows: Section 1. Extension. The “Term” provision in Ordinance No. 465 is hereby amended to extend the termination date for two years with a new termination date of July 2, 2026. The Franchise Agreement may be terminated earlier as provided by Ordinance No. 465, or when a new franchise agreement becomes effective, whichever occurs first. Section 2. Corrections. Upon approval of the City Attorney, the City Clerk and the code reviser are authorized to make necessary corrections to this Ordinance, including the correction of clerical errors; references to other local, state or federal laws, codes, rules or regulations; or ordinance numbering and section/subsection numbering. Section 3. Severability. If any section, clause, or provision of this Ordinance or its application to any person or circumstance is declared by a court to be invalid, the remainder of this Ordinance or the application of the provision to other persons or circumstances shall not be affected. Section 4. Effective Date. This Ordinance or a summary thereof consisting of the title shall be published in the official newspaper of the City of Quincy and shall take effect and be in full force five days after passage and publication. ENERGY FACILITY SITE EVALUATION COUNCIL STATE ENVIRONMENTAL POLICY ACT DETERMINATION OF SIGNIFICANCE AND REQUEST FOR COMMENTS ON SCOPE OF ENVIRONMENTAL IMPACT STATEMENT For the Transmission Programmatic Environmental Impact Statement Date: June 28, 2024 Lead Agency: Energy Facility Site Evaluation Council (EFSEC) Agency Docket Number: 181034 Proposal Description: EFSEC is preparing a programmatic environmental impact statement (PEIS) under the State Environmental Policy Act to assess probable significant adverse environmental impacts from electrical transmission facilities with a nominal voltage of 230 kilovolts (kV) or greater at a broad level. The Legislature directed EFSEC to conduct a nonproject environmental review for this type of facility in Revised Code of Washington (RCW) Chapter 43.21C.405. The PEIS will assess and disclose probable significant adverse environmental impacts from electrical transmission facilities with a nominal voltage of 230kV or greater and identify related avoidance, minimization, and mitigation measures. Location of Proposal: The Legislative directive is to consider locations in Washington state that contain standard attributes for likely development such as proximity to existing transmission or complementary facilities and planned corridors for transmission capacity construction, reconstruction, or enlargement. The PEIS is not required to include geographic areas that lack the characteristics necessary for electrical transmission facilities with a nominal voltage of 230kv or greater. EFSEC will use input from scoping to assist in determining the area(s) of study for the PEIS. EIS Required: In RCW 43.21C.405, the Legislature directed EFSEC to prepare a nonproject environmental impact statement pursuant to RCW 43.21C.030, that assesses and discloses the probable significant adverse environmental impacts and identifies related mitigation measures for electrical transmission facilities with a nominal voltage of 230kv or greater.  EFSEC has identified the elements of the environment listed in the SEPA rules (Washington Administrative Code [WAC] 197-11-444) and those identified in RCW 43.21C.405 as relevant for inclusion in the PEIS to determine if there are any significant environmental impacts. These include: • Earth resources (including seismic hazards) • Air quality • Water resources • Vegetation • Wildlife and Habitat • Energy and natural resources • Land and shoreline use, including military, agricultural, and ranching uses • Historic and cultural resources, including tribal rights, interests, and resources • Visual aspects • Noise and vibration • Recreation • Public health and safety • Transportation • Public services and utilities • Socioeconomics, including environmental justice and overburdened communities as defined by RCW 70A.2.010 • Cumulative impacts, including landscape scale habitat connectivity and wildlife migration corridors For transmission line projects utilizing an existing transmission right-of-way or that are located along a transportation corridor, the PEIS will be limited to the proposed action and a no action alternative. For transmission line projects that do not meet these criteria, EFSEC will determine the range of alternatives to be analyzed at the end of the scoping period after comments are reviewed. Scoping: Agencies, affected tribes, and members of the public are invited to comment on the content and emphasis (the scope) of the PEIS. RESOLUTION NO. 2024-331 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF GEORGE, WASHINGTON, DESIGNATING THE OFFICIAL NEWSPAPER OF GENERAL CIRCULATION FOR PUBLICATION OF LEGAL NOTICES; AND REPLEAING PRIOR INCONSISTENT RESOLUTIONS.   WHEREAS, RCW 35A.21.230 requires cities to designate, by resolution, an official newspaper that is of general circulation in the jurisdiction to publish legal notices; and WHEREAS, the City of George (“City’) previously designated the Quincy Valley Post Register (the “Register”) as the official newspaper for the City; and WHEREAS, the Register has announced it has or will cease its printing operations such that it will no longer be available to provide legal publications in the City; and WHEREAS, as a result of the Register’s service termination, the City must designate a new official newspaper of general circulation in the City for purposes of publication of legal notice in compliance with RCW 35A.21.230; and WHEREAS, the Columbia Basin Herald is a newspaper that is published at least weekly and is of general circulation in the City; and WHEREAS, the City Council concurs in the recommendation of the Mayor and City staff that the Columbia Basin Herald newspaper should be designated as the official newspaper of the City as required by RCW , NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF GEORGE, WASHINGTON HEREBY RESOLVES AS FOLLOWS: Section 1. The Columbia Basin Herald, which is a qualified newspaper of general circulation within the City, is hereby designated as the official newspaper of the City to be used by the City for purposes of making legally required notice publications. Section 2. Any prior inconsistent Resolution is hereby repealed. Section 3.
