Notice of Joint Local-State Public Comment Period, SEPA Environmental Review, and Public Hearing: Moses Lake Shoreline Master Program 2023 Periodic Review NOTICE IS HEREBY GIVEN that the City of Moses Lake and Washington State Department of Ecology (Ecology) are seeking comments on the City’s Shoreline Master Program (SMP) periodic review and proposed SMP Amendments. The joint 30-day local/state public comment period will run from January 16, 2023 through February 16, 2023, at 5:00 p.m. Authority for the periodic Review is based on Washington’s Shoreline Management Act (Ch. 90.58 RCW) and related rules. These amendments were developed by Moses Lake City to comply with WAC 173-26-090, which requires all local governments to review their SMPs on an eight-year schedule set in state law and revise it if necessary. The review ensures the SMP keeps up with changes in state law, changes in other City plans and regulations, and other changed circumstances. The city has elected to use the optional joint review process to combine the local and Ecology comment periods, as allowed under WAC 173-26-104. No additional comment period will occur during the state review process. Comments provided to the city will be reviewed by both the City and Ecology. There is no need to send comments directly to Ecology. Comments may be submitted to project consultant Rachel Granrath at rachel.granrath@scjalliance.com, or to Michelene Torrey, MTorrey@CityofML.com, Planning Permit Technician, or mailed to Moses Lake Community Development Department at 321 S Balsam Street, P.O. At the conclusion of the comment period, the city will prepare a response to comments and determine whether changes are needed. Public comments and City responses will be shared with Ecology. After local adoption, the SMP amendment will be formally submitted to Ecology for final action per WAC 173-26-104 and WAC 173-26-110. Ecology will review amendments for consistency with state laws and rules. Ecology may either approve the program as adopted or may recommend changes. Notice of Application & Proposed Mitigated Determination of Non- Significance - Date of Notice: January 20, 2023 Notice is hereby given that a JARPA (Shoreline Substantial Development Permit) Application and SEPA Checklist were received by Grant County on August 24, 2022 from Kim Falconer (Designated Contact: John Hermann, CBMI, 3740 Thayer Rd NE, Moses Lake, WA 98837) and was found to be technically complete on January 17, 2023. Grant County expects to issue a Mitigated Determination of Non- Significance for this proposal and the Optional DNS Process in WAC 197-11- 355 is being used. This proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. This may be the only opportunity to comment on the environmental impacts of the proposal and the proposed mitigation measures. A copy of the subsequent threshold determination may be obtained upon request. PROPOSED MITIGATION MEASURES: 1. Limit the size of the project to the minimum amount necessary. 2. Project requires mitigation at a rate of 1:1 for all new developments to ensure a no net loss of shoreline ecological function (approximately 410 sq. ft. of plantings). 3. Construction shall be done during the annual draw-down (when the water level is low enough to allow work with minimal disturbance of lands below the Ordinary High Water Mark). 4. Best management practices for control of erosion and sedimentation shall be implemented for the project. PROJECT: The project is proposing to construct an 8’ X 20’ dock, install a 9’ x 10’ boat lift and and a 4’ x 40’ freestanding walkway. To mitigate the disturbance, the proponent will plant Bunch Grasses, Snow Berry, Wild Rose and Reposis Dogwood bushes on each side of the property line adjacent to the dock and boatlift for a combined total of 410 square feet of mitigation coverage. ADDITIONAL PERMITS REQUIRED: WDFW HPA. LOCATION: The project is located at 2808 Wild Goose Rd NE on Moses Lake in Moses Lake, WA 98837.
