City of Warden Notice of Nonconformance Continuation and Hearing Name of Proponents: Johnathan Pittman and Brittney Pittman Reference Number: NCU-05-2022 (Pittman) Date of Review Request: August 10, 2022 Date Notice Issued: September 16, 2022 Date of Public Hearing: October 11, 2022 at 7:00pm Description of Proposed Project Action and Permits: The proponent is requesting the continuation of the nonconforming use assembly hall/event center in Warden located at 720 S Pine St known as Grant County Assessor Parcel #061712000 zoned as R-1. The parcel is 0.75 acres in size and was purchased by the proponent on November 23, 2021 from the Warden Mennonite Church. The proponent vested a zone change request application with the City of Warden on May 5, 2022 and amended zone change request to proceed with the continuation of nonconforming use per Warden Municipal Code Chapter Title 17.69. The historic and current use of the property is an assembly hall, which is not an outright permitted use in the R-1 zone per WMC 17.20.030. Project Location: Use is located at 720 S Pine St; POR BLK 1 & 2 MENNO ADD WARDEN (TGW per BLA) That portion of the Southwest quarter of the Southwest quarter of the Southwest quarter of the Northeast quarter of Section 15, Township 17 North, Range 30 East, W.M., City of Warden, County of Grant. Requested Approvals, Actions and/or Required Studies: The building official, fire chief, and planner shall make written summary of their findings and submit, together with any conditions that, in their opinion, should be attached to the use, to the planning agency (planner). Other Permits Not Included, To the Extent Known: To the extent known, no other permits apply. Existing Environmental Documents and Where They Can Be Reviewed: Information regarding this project may be requested and reviewed at 121 S Main by appointment. Threshold Determination: No Environmental review was required for this proposal based on the scope of the work as identified in WAC 197-11-800(6). Environmental documentation is not included in this nonconformance continuation request. Statement of Preliminary Determination: The City Planner has determined the nonconforming use shall be allowed to continue pursuant to WMC 17.69.010. The historic use of Parcel #061712000 has been an assembly hall since at least 1957, when the Warden Mennonite Church purchased the property. The building was remodeled in 2000 and subsequently purchased by the proponents in 2021. No other use has occurred at the property since the purchase by the proponents. The date of purchase to the vested application date of May 5, 2022, is 5 months and 12 days, within the six-month continuation of use period required per WMC 17.69.010. The continuation of nonconforming use will be subject to the regulations in WMC 17.69. Statement of Public Comment Period: The fourteen (14) day comment period commences on September 27, 2022, and lasts through October 11, 2022. Any interested person/party has the right to comment on the proposal, receive notice of and participate in any hearing, request a copy of the decision once it is made and may appeal the decision subject to the requirements of Title 17. Notice of Public Hearing: Pursuant to Warden Municipal Code Title 17 a public hearing is scheduled to hear public comment on the continuation of nonconforming use and attached conditions, if any. The public is invited to attend and provide comment on this proposal. NEWS RELEASE PREPARATION FOR LOGIC AND ACCURACY TEST In preparation for the November 8, 2022 General Election, a Logic and Accuracy Test will be performed. A "test deck" of ballots will be scanned. This test verifies that the system will correctly count the votes cast for all candidates and measures appearing on the ballot.
