Sunset Drive, Moses Lake, WA | 98837 | | 1409 W. Sunset Drive, Moses Lake, WA | 98837 | ____________________________________| Comes now the City of Moses Lake and complains against that certain building alleging that the said building is a dangerous building for the reasons as follows: 1. The owner, or reputed owner, and persons having an interest therein of said building are: Lois Pellham Azell Pellham Novad Management Consulting MetLife Bank N.A., MetLife Home Loans Housing & Urban Development Department of Social and Health Services 2. The street address of said property and building located thereon is described as: 1415 W. Sunset Drive, Moses Lake, Washington 98837, Moses Lake, WA 98837 1409 W. Sunset Drive, Moses Lake, Washington 98837, Moses Lake, WA 98837 The legal description of the property upon which the building is located is further described as: Parcel: 111237000 - LOT 4 BLOCK 5 SUNSET PARK ADD Parcel: 111236000 - LOT 3 BLOCK 5 SUNSET PARK ADD Grant County Assessor's parcel numbers Parcel: Parcel: 111237000 - LOT 4 BLOCK 5 SUNSET PARK ADD Parcel: 111236000 - LOT 3 BLOCK 5 SUNSET PARK ADD 3. A general description of the building to be dangerous: Residence to include an attached garage structure located on parcels 111237000 and 111236000, is a single-story residential unit. The residence is located in Residential Zone, R2- Single/Two Family residential. The structure is heavily damaged due to a fire to the structure and is deemed non-habitable. The internal and external main living/kitchen area suffered heavy fire damage, to include the roof line structure. The external siding on the front and sides of the residence are heavily damaged. 4. The building was inspected by the City of Moses Lake's building official. The following specific items of disrepair causing said building to be considered unsafe or unsanitary, or dangerous to the health, morals, safety, or general welfare of the people of the city and were identified during said inspection: MLMC 16.08. 020.I Those which because of their condition are unsafe or unsanitary, or dangerous to the health, morals, safety, or general welfare of the people of the city MLMC 16.08. 020.D Those which have become damaged by fire, wind, or other causes so as to have become dangerous to life, safety, morals, or the general health and welfare of the occupants or the people of the city. MLMC 16.08.020.F Those having light, air, and sanitation facilities which are inadequate to protect the health, morals, safety, or general welfare of human beings who live or may live therein. 5. Violations: Moses Lake Municipal Code Section 16.08.030 - Standard Repair, Vacation, or Demolition : MLMC 16.08.030 The following standards shall be followed in substance by the Building Official and Board of Appeals in ordering repair vacation, or demolition of any building. A. If the dangerous building can reasonably be repaired so that it will no longer exist in violation of the terms of this chapter, it shall be ordered repaired by the Building Official or Board of Appeals. B. If the dangerous building is in such condition as to make it dangerous to the health, morals, safety, or general welfare of its occupants, it shall be ordered to be vacated by the Building Office or the Board of Appeals. C. If the dangerous building is fifty percent (50%) damaged, decayed, or deteriorated in value, it shall be demolished. Value as used in this subsection shall be the valuation placed upon the building for purposes of general taxation. D. If the dangerous building cannot be repaired so that it will no longer exist in violation of the terms of this chapter, it shall be demolished. E. If the dangerous building is a fire hazard existing or erected in violation of the terms of this chapter or any ordinance of the city or statute of the state, it shall be demolished, providing the fire hazard is not eliminated by the owner or other interested persons within a reasonable time. 6. Violations: Moses Lake Municipal Code Section: 16.08.040 - Dangerous Building Declared Nuisance: MLMC 16.08.040: All dangerous buildings within the terms of Section 16.08.020 of this chapter are declared to be public nuisances, and shall be repaired, vacated, or demolished as provided in this chapter. 7. The building is not presently occupied but could cause injury to the health and general of those entering therein and therefore shall remain vacant. No persons shall enter or occupy the building. 8. The items set forth in paragraph 4 hereof are of such a nature and such an extent they cannot be readily repaired or removed. To adequately renovate the building would require extensive rehabilitation with an estimated cost in excess of half of the assessed value of said building according to the Grant County Assessor's records. 9. It is the opinion of the Moses Lake Building Official that it would not be reasonable to repair said building and the same should be demolished. 10. A hearing shall be held before the Moses Lake Building Official, or his appointed designee, in the Community Development Department Conference Room, 321 S. Balsam Drive, Moses Lake, Grant County, Washington, at 2:00pm, or attend via Zoom; Join Zoom meeting https://cityofml.zoom.us/j/83925656568, Meeting ID: 839 2565 6568, or as soon thereafter as the same may be heard on Tuesday, the 4th day of January, 2022, which is not less than ten (10) days nor more than thirty (30) days after the service of this complaint and not less than fifteen (15) days nor more than thirty (30) days from the date of the first publication, at which time the owner and all parties of interest shall be given the right to: (1) file an answer, (2) appear in person or otherwise, and (3) give testimony at said time and place. You are hereby advised that your failure to voluntarily undertake to repair or demolish said building or to appear at said hearing may result in the demolition of said building by the City of Moses Lake at your expense, and the cost thereof will be assessed against your property and collected thereafter by the Grant County Treasurer as part of your general taxes. This assessment shall constitute a lien against your property of equal rank with state, county, and municipal taxes. It should also be noted that if the building is not repaired or demolished prior to the hearing on Tuesday, January 4, 2022, but later is repaired by the owner or person having an interest in the property, all costs incurred by the City of Moses Lake in processing the dangerous building abatement action will be assessed against the property and collected thereafter as indicated above. This complaint is issued pursuant to Chapter 16.08 of the Moses Lake Municipal Code and Chapter 35.80 RCW and may be subject to condemnation pursuant to Chapter 35.80A RCW. NOTICE IS HEREBY GIVEN THAT AN OPEN RECORD PUBLIC MEETING WILL BE HELD December 28, 2021 at 3:00 p.m. in the Grant County Commissioners Hearing Room, Courthouse, Ephrata, WA to consider the following budget extension requests: * Facilities and Maintenance in the amount of $96,832.72 for an insurance reimbursement check received for flooding in the courthouse basement, and an overage of their account. They are requesting $4,667.20 from current expense to fund #001.112. * Multi Agency Communications Center (MACC) in the amount of $2,500,000.00 for Fund135-186 Emergency Comm. Serv. for the purchase of TAIT radios for all of the MACC User Agencies. * Public Works in the amount of $800,000.00 for Equipment Rental and Revolving Fund (ER&R 510) due to delivery delays of 6 vehicles that were purchased in 2020 but not received until 2021 due to the pandemic. These items were not brought forward to the 2021 budget. *Veterans Assistance (Fund 104) in the amount of $7,500 to cover expenses incurred during 2021. INET Forfeiture (Fund 109) in the amount of $25,000 to cover excess expenses incurred during 2021. Treasurer's O&M (Fund 111) in the amount of $30,000 to cover costs for additional foreclosure sale held during 2021. Dispute Resolution (Fund 136) in the amount of $3,000 to cover excess expenses incurred during 2021. Building/Fire Marshal (Fund 138) in the amount of $260,000 to cover excess salary, standby, leave payout and benefits expenses incurred due to the addition of 4 positions in 2021. Sheriff Surplus (Fund 140) in the amount of $1,500 to cover excess expenses incurred during 2021. Other Payroll Benefits (Fund 508) in the amount of $35,000 to cover excess benefit fees incurred during 2021. *Grants Administration Fund #190.001 for the Washington State Department of Commerce Grants in the amount of $5,625,235.57 for pass through funding for various grants. *Public Defense Department to receive funds from the Washington State Office of Public Defense in the amount of $114,428.00 for the State v.
