LEGAL NOTICE Proposed Amendment to Renewal Master Water Service Contract with the East Columbia Basin Irrigation District, Columbia Basin Project, Washington Under the authority of the Act of Congress approved June 17, 1902 (32 Stat. 388) and acts amendatory thereof or supplementary thereto, and particularly the Act of August 30, 1935 (49 Stat. 1028), Section 9(e) of the Act of August 4, 1939 (53 Stat. 1196), the Act of March 10, 1943 (57 Stat. 14), and the Act of October 1, 1962 (76 Stat. 677), the United States Bureau of Reclamation proposes to enter into a contract amendment to the long-term Renewal Master Water Service Contract, Contract No. 159E101882, dated September 22, 2015, with the East Columbia Basin Irrigation District (District) that would, among other things, authorize the District to provided Columbia Basin Project irrigation water as groundwater replacement irrigation water service to additional irrigable lands located within the Odessa Subarea and within the service area of the District. A legal notice for the proposed contract amendment was first published in September 2016. Contract negotiation sessions with the District were held publicly July 17, 2017 and July 24, 2017 in Yakima, WA; May 25, 2018, July 16, 2018, and August 30, 2018, in Moses Lake, WA; March 21, 2019 in Spokane, WA; and July 11, 2019, and August 16, 2019 in Moses Lake, WA. NOTICE OF ROAD CONSTRUCTION Central Washington Asphalt, Inc. will begin road construction from MP 2.01 to MP 3.55 and MP 0.00 to MP 0.10, Bench Rod to 500' N of Thacker Road Intersection. Work included is grading, shoulder widening, culvert replacement, resurfacing the road with crushed surfacing and an asphalt wearing surface and other work. Work is scheduled to begin on 9/16/19 and end approximately 12/6/19. Notice of Application & Proposed Mitigated Determination of Non-Significance - Date of Notice: September 12, 2019 Notice is hereby given that a JARPA (Shoreline Substantial Development Permit) Application and SEPA Checklist were received by Grant County on July 24, 2019 from Mary Shipley (Designated Contact: Eldon Broughton, Broughton Construction, LLC, 2403 Westshore Drive NE, Moses Lake, WA 98837) and was found to be technically complete on September 9, 2019. Grant County expects to issue a Mitigated Determination of Non-Significance for this proposal and the Optional DNS Process in WAC 197-11-355 is being used. This proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. This may be the only opportunity to comment on the environmental impacts of the proposal and the proposed mitigation measures. A copy of the subsequent threshold determination may be obtained upon request. PROPOSED MITIGATION MEASURES: 1. Limit the size of the project to the minimum amount necessary. 2. Project requires mitigation at a rate of 1:1 for all new developments to ensure a no net loss of shoreline ecological function (approximately 1,360 sq. ft. of plantings). 3. Construction shall be done during the annual draw-down (when the water level is low enough to allow work with minimal disturbance of lands below the Ordinary High Water Mark). 4. Best management practices for control of erosion and sedimentation shall be implemented for the project. PROJECT: The project is proposing to install an 8' x 25' cantilevered dock, install a 10' x 10' boat lift adjacent to the dock, level and gravel an approximately 220' long gravel pathway and level an approximately 1000 square foot picnic area/seating area near the dock. ADDITIONAL PERMITS REQUIRED: WDFW HPA. LOCATION: The project is located at 3619 Westshore Drive NE on Moses Lake in Moses Lake, WA 98837. The parcel is Tax #9551 in the Northwest quarter of Section 18, Township 19 North, Range 28 East, WM, Grant County, WA. Parcel #17-0747-005. SHORELINE ENVIRONMENT: Shoreline Residential.
