NOTICE OF PRIVATE SALE OF FARMLAND NOTICE IS HEREBY GIVEN THAT one parcel of land ("Parcel 'A'") will be offered at a private sale on October 30, 2019. Parcel "A" is approximately two thousand forty (2,040) acres, consisting of: Four pieces of land offered by the ESTATE OF LOREN J. TOTUSEK; and one piece of land offered by NORMAN OTT and MARSHA GARNER. Parcel "A" is situated in Lincoln County, State of Washington, and is described as follows: Parcel "A" (Lincoln County) The Northeast Quarter and the South half of Section 21, Township 22 North, Range 32 E.W.M., records of Lincoln County, State of Washington Parcel No.: 2232021900030 Approximately 480 acres AND The Southwest Quarter of Section 22, Township 22 North, Range 32 E.W.M., records of Lincoln County, State of Washington Parcel No.: 2232022300030 Approximately 160 acres AND All of Section 27, Township 22 North, Range 32 E.W.M., records of Lincoln County, State of Washington Parcel No.: 2232027000030 Approximately 640 acres AND All of Section 28, Township 22 North, Range 32 E.W.M., records of Lincoln County, State of Washington Parcel No.: 2232028000030 Approximately 640 acres (Includes Farm Residence) AND The Northwest Quarter of Section 22, Township 22 North, Range 32 E.W.M., records of Lincoln County, State of Washington Parcel No.: 2232022200010 Approximately 160 acres *Complete legal descriptions to be furnished by title company. The acreages are believed to be correct but are not guaranteed. No survey will be furnished by the Sellers. In all cases, no adjustment will be made in price based on any subsequent survey conducted by Buyer. It is the Bidder/Buyer's responsibility to verify the accuracy of the acreage. Terms of Sale shall be cash at closing by way of wire transfer made payable to Carpenter, McGuire & DeWulf Trust Account. All bidders shall bid in a total dollar amount for the entire parcel and not on a per acre basis, given that acreages vary and there is no guarantee as to acreage. All bids shall be in writing and must be submitted in a sealed envelope on or before Noon (12:00 o'clock p.m.), on October 30, 2019. Bids shall be addressed and mailed to "Totusek, Ott, and Garner Land Bid Sale" in care of Mark DeWulf of Carpenter, McGuire & DeWulf, P.S., P.O. Box 457, Odessa, WA 99159 in time to arrive at said address prior to the above date. Each bid shall be accompanied by a personal check in the amount of ten percent (10%) of the bid price payable to the order of Carpenter, McGuire & DeWulf Trust Account as evidence of the bidder's good faith, said amount to be a legal obligation and forfeited to the Seller by the successful bidder unless the bidder complies with his bid. All bids will be opened at Noon (12:00 o'clock p.m.) on October 30, 2019 at the offices of Carpenter, McGuire & DeWulf, P.S., in Odessa, WA. Unsuccessful bidders will be notified and have until Noon (12:00 o'clock p.m.) on November 6, 2019 to make and file a second bid higher than that of the first successful bidder; provided that such second bids are in writing and submitted in a sealed envelope with a bid deposit as above provided, and further provided that the second bid shall in no event be less than seven percent (7%) higher than the original highest bid of the first successful bidder. The first successful bidder shall then be notified and have until Noon (12:00 o'clock p.m.) on November 13, 2019, in which to make and file a bid better than that of the highest second successful bidder, said bid to be not less than two percent (2%) higher than the highest second successful bid and thereafter no further bids will be accepted. Seller reserves the right to reject any and all bids. All submitted bids shall be sealed with bid deposits as indicated herein. The Sellers will furnish title insurance and will pay the premium therefore and will also pay real estate excise tax and one-half the closing fees charged by the closing attorneys Carpenter, McGuire & DeWulf, P.S. The successful bidder shall pay the recording fees and one-half the closing fees charged by the above attorneys. The real property taxes payable in 2019 shall be prorated as of the date of closing. Closing shall transpire no later than December 18, 2019. The successful bidder takes the property and all buildings as is. The Sellers will receive the 2019 CRP payment.
