Moses Lake man sentenced for attempted incest with teen
MOSES LAKE — A Moses Lake man received a jail sentence for attempted incest.
Jose Magana Magana, 21, pleaded guilty in Grant County Superior Court to attempted first-degree incest. The charge carried with it a standard sentencing range of 9-10.5 months in jail. Magana Magana was sentenced under a special sex offender sentencing alternative and received a 58-day jail sentence, with credit for time served. A charge of third-degree attempted child rape was dismissed in a plea agreement between the defense and the prosecution.
On Aug. 26, 2017 the Moses Lake Police Department was told of a possible assault involving a child. Child Protective Services advised a teen disclosed to a counselor one of his family members had attempted to rape him. The victim was interviewed by police and claimed on Aug. 19, 2017 Magana Magana called him into a room. The victim says he thought the defendant was going to rape him, but Magana Magana got an alert on one of his devices and had to leave the room.
The victim was able to run and lock himself in another room after Magana Magana left. He advised the incident was the first involving Magana Magana and nothing like it had occurred in the past. Magana Magana was interviewed by police as well and admitted to the encounter with the victim.
He confided to police his intention to have sex with the victim, but he said he wasn’t able to so he “gave up and left the room.” Magana Magana also admitted to taking at least three shots of liquor before the encounter.
