NOTICE OF CLOSED RECORD APPEAL

NOTICE IS HEREBY GIVEN that the Franklin County Board of Commissioners has requested a review of the Planning Commission’s recommendation for an application by Rodney Burns, 4161 Burns Road, Pasco, WA 99301 in a closed record appeal.

ZC 2016-01, is an application to rezone approximately 198 acres of land located within the City of Pasco Urban Growth Area Boundary. The zone change involves the following:

1. Two (2) tax parcels, consisting of approximately 39 acres, from Residential Suburban 40,000 (RS-40) to Residential Suburban 20,000 (RS-20); and

2. Eleven (11) tax parcels, consisting of approximately 159 acres, from Residential Transition (R-T, a five acre minimum lot size zoning district) to Residential Suburban 20,000 (RS-20).

The PLANNING COMMISSION recommended approval of ZC 2016-01 with findings of fact and conditions of approval. The Board of Commissioners have determined that a closed record appeal is necessary to review the Planning commission’s recommendation. The closed record appeal will focus on whether or not the Board of Commissioners wish to include the following statement as a condition of approval for the zone change application:

“It is recommended that any future development of these parcels be limited to one or two access points from local access roads within any development on Burns Road, Kohler Road and Shoreline Road. Access from individual lots to Burns Road, Kohler Road and Shoreline Road should not be permitted. Limited access will help reduce conflict points and potential accidents on these roads”.

The subject parcel is described as follows:

LEGAL DESCRIPTION:

The rezone involves the following Franklin County Tax Parcel Numbers located north of Burns Road: 126-150-212, 126-150-067, 126-150-138, 126-150-147, 126-150-156, 126-150-165, 126-150-174, 126-150-094; and

The rezone involves the following Franklin County Tax Parcel Numbers located south of Burns Road: 126-160-136, 126-160-145, 126-160-154, 126-160-163, and 126-160-127.

NON-LEGAL DESCRIPTION:

The 198 acres (approximate) is generally located northwest of the City of Pasco, west of Broadmoor Blvd., south of Jayleen Way, south of Sandy Ridge Road, along both the north and south sides of Burns Road, near the Burns Road and Kohler Road intersection along the Columbia River.

NOTICE IS FURTHER GIVEN that said application will be considered by the Franklin County Board of Commissioners at a closed record appeal on May 18, 2016 at the hour of 9:00 a.m. in the Franklin County Courthouse, Commissioners Meeting Room, 1016 North 4th Avenue, Pasco, WA 99301. Since this is a closed record appeal, new public testimony or information will not be accepted. The County Commissioners may ask questions of the applicants and any interested party in attendance.
