These notices shall satisfy two separate but related procedural requirements for activities to be undertaken by the Washington State Department of Commerce.
REQUEST FOR RELEASE OF FUNDS
On or about Tuesday, February 10th, 2015, the Washington State Department of Commerce will submit a request to the US Department of Housing and Urban Development (HUD) for the release of HOME Investment Partnership (HOME) Program funds under Title II of the National Affordable Housing Act of 1990, as amended, to undertake a project known as Guadalupe Haven, for the purpose of newly constructing 86 units of affordable housing for very low and extremely low income farmworkers in the city of Othello. The State of Washington has completed review of the described project, to which the State of Washington intends to make an award of HUD, HOME Investment Partnerships Program funds in the amount of approximately $1,500,000 of the total cost of approximately $12,917,983 and now proposes to execute the award of funds to allow the project to proceed.
FINDING OF NO SIGNIFICANT IMPACT
The Washington State Department of Commerce has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the State of Washington Department of Commerce, Community Services and Housing Division, 1011 Plum Street, Olympia, WA 98504 for review and may be examined or copied weekdays Monday through Friday, 8 am to 5 pm.
PUBLIC COMMENTS
Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to Diane Klontz, Assistant Director for Community Services and Housing, Department of Commerce/Housing Trust Fund, PO Box 42525, Olympia WA 98504-2525. All comments received by Sunday, February 8th, 2015, will be considered by the Washington State Department of Commerce prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
RELEASE OF FUNDS
The State of Washington Department of Commerce certifies to HUD that Diane Klontz, in her capacity as Assistant Director for Community Services and Housing, consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Washington State Department of Commerce to use Program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD will accept objections to its release of funds and the Washington State Department of Commerce's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the Name of RE; (b) the RE has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient has committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to U.S. Department of Housing & Urban Development, Attention: Office of Community Planning & Development, 909 First Avenue, Seattle, WA 98104-1000. Potential objectors should contact HUD to verify the actual last day of the objection period.
