ACTIVE WATER RIGHT CHANGE/TRANSFER APPLICATIONS
Public Notice is hereby given that the Benton County Water Conservancy Board (BCWCB) has formally received applications for water right change/transfer and has designated such applications active for Water Board review.
Active application filed 5/5/2015 by: Foothill Vineyards, L.L.C. and Rattlesnake Vineyards, L.L.C. of Grandview, WA. The application relates to a portion of Surface Water Certificate No. 5772, portion designated as part (A), surface water right from Welsh Creek (or Welch Creek) (designated as BENT-15-05 for tracking purposes), with a priority date of 2/24/1953, and with quantities up to 1 cubic foot per second (cfs), 351.77 acre-feet per year (af/yr), for irrigation of 108.8 acres; period of use 5/1-11/30. The certificate issued for three points of diversion within: SW1/4 Sec. 33, and E1/2 of Secs. 29 and 32; all within T27N R35EWM. The existing place of use, for the (A) portion, is located within portions of Sec. 29, 32 and 33, T27N, R35EWM; complete legal description available from Board.
Active application filed 5/5/2015 by: Foothill Vineyards, L.L.C. and Rattlesnake Vineyards, L.L.C. of Grandview, WA. The application relates to a portion of Certificate No. G3-01223C, portion designated as part (B), ground water right from two wells (designated as BENT-15-06 for tracking purposes), with a priority date of 3/6/1968, and with quantities up to 433 gallons per minute (gpm), 217.55 af/yr, for irrigation of 108.8 acres; period of use 5/1-11/30. The certificate issued for two wells within: SW1/4NE1/4 and SE1/4SE1/4 Sec. 29, T27N R35EWM. The existing place of use, for the (B) portion, is located within portions of Sec. 29, 32 and 33, T27N, R35EWM; complete legal description available from Board.
That both of said applications request to change the source locations to the following: Columbia River via pump diversion and two proposed well sites all within Benton County and within Gov't Lot 4 Sec. 27, SE1/4NE1/4 or NE1/4SE1/4 Sec. 27 and S1/2SE1/4 Sec. 23; all within T6N, R30EWM. That both applications request to change the place of use to the following: NE1/4 and NW1/4SE1/4 Sec. 23, and NW1/4NW1/4 Sec. 24; T6N, R30EWM. Instream flow component: within intervening reaches of Welsh Creek and Columbia River. That both applications request to increase acres for irrigation to a total of 240 acres in combination. That both applications request to add purposes of use for commercial purposes and instream flow. That both applications request to change the season of use to be 2/15-11/30.
Under WADOE Rule WAC 173-153 and other agency regulations, any formal protest of an application must be sent to: Department of Ecology, Cashiering Unit, PO Box 47611, Olympia, WA 98504-7611 within thirty (30) days from September 4, 2015.
($50.00 protest fee required for each application being protested). A valid protest must include: name, address, phone number of protesting party; identification of the change/transfer being protested; a detailed statement of proper basis for protest. All letters of protest become public records.
Any person, agency, or tribe desiring to submit comments, and other information, to the Water Board regarding the subject application may do so either in writing or verbally at any public meeting of the Board.
