NOTICE: ANNOUNCEMENT OF AVAILABILITY OF DRAFT PERMIT MODIFICATION

The Port of Moses Lake has applied for a State Waste Discharge Permit (SWDP) modification in accordance with the provisions of Chapter 90.48 Revised Code of Washington (RCW) and Chapter 173-216 Washington Administrative Code (WAC).
The Port submitted an application for a permit modification to Ecology requesting an increase of the average influent monthly flow from 300,000 gallons per day (gpd) to 600,000 gpd and increase the maximum daily influent flow from 400,000 to 900,000 gpd.
Because the influent flow limit should be a design criteria and not a permit limit, the permit modification will remove the average influent flow limit of 300,000 gpd and the maximum daily influent flow limit of 600,000 gpd and will add a design average influent flow of 400,000 gpd and a maximum daily influent flow of 900,000 gpd.
No other condition or requirement of the 2014 Permit is hereby affected by this amendment. Ecology is issuing a draft amended permit and fact sheet amendment and is only accepting comments on the modified portions.
The wastewater, following treatment, must meet the requirements of the Washington State Water Pollution Control Act and applicable regulations for a permit to be issued. A final determination will not be made until all timely comments received in response to this notice have been evaluated.

Interested persons are invited to submit written comments regarding the proposed permit modification. All comments must be submitted within 30 days after publication of this notice to be considered for the final determination. Comments must be received by our office no later than May 21, 2015. Any interested party may request a public hearing on the proposed permit within 30 days of the publication date of this notice. The request for a hearing shall state the interest of the party and the reasons why a hearing is necessary. The request should be sent to the above address. The Department will hold a hearing if it determines that there is significant public interest. If a hearing is to be held, public notice will be published at least 30 days in advance of the hearing date. Any party responding to this notice with comments will be mailed a copy of a hearing public notice.
