Notice of Application and Proposed Mitigated Determination of Non-Significance

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA Checklist received by Grant County on May 21, 2013 from Rick Penhallurick (Designated Contact: John Hermann, CBMI, 3740 Thayer Rd. NE, Moses Lake, WA 98837, 509-989-4318) were found to be technically complete on September 9, 2014.

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA Checklist received by Grant County on May 21, 2013 from Rick Penhallurick (Designated Contact: John Hermann, CBMI, 3740 Thayer Rd. NE, Moses Lake, WA 98837, 509-989-4318) were found to be technically complete on September 9, 2014. Grant County expects to issue a Mitigated Determination of Non-Significance for this proposal, and the Optional DNS Process in WAC 197-11-355 is being used. This proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. This may be the only opportunity to comment on the environmental impacts of the proposal and the proposed mitigation measures. A copy of the subsequent threshold determination may be obtained upon request. PROPOSED MITIGATION MEASURES: 1. Proper erosion and sediment control practices must be used to prevent upland sediments from entering surface water. The landowner/applicant shall take all measures as necessary to minimize and control sediment run-off into Moses Lake during construction and/or after completion of this project, including, but not limited to: (a) Use of silt fences in conjunction with bales of hay to prevent and/or lessen soil erosion, (b) Replant disturbed soils with native vegetation following construction, (c) Consult with the WA Dept. of Fish and Wildlife (Ephrata Office) in order to determine the best methods and/or processes of erosion control, (d) Any excavated material(s) must be deposited landward of the shoreline and/or removed from the subject parcel, thereby lessening sedimentation and erosion, (e) Any rocks moved during construction for the placement of support legs for the dock must be deposited underneath the dock thereby enhancing habitat for native wildlife. 2. The landowner/applicant shall alter the shoreline only to the minimum extent necessary so as to complete the project as proposed. 3. The amount of shoreline altered and/or wetland vegetation disturbed by construction activities shall be kept to the minimum extent necessary in order to complete the project. Upon completion of the project, any/all disturbed areas shall be replanted with native wetland, aquatic, and/or terrestrial species as approved

by the WA Dept. of Fish and Wildlife. 4. Construction shall be done during the annual draw-down of Moses Lake (when the water level is low enough to allow work with minimal disturbance of lands below the Ordinary High Water Mark). PROJECT: This proposal is for the construction of a 4-ft. wide x 10-ft. long freestanding walkway connecting to a 10-ft. wide x 20-ft. long freestanding dock. The overall length of these structures combined will be 30 feet. This proposal also includes excavation as necessary for and construction of a 12-ft. wide x 30-ft. long poured-in-place concrete boat launch, a 16-ft. wide x approximately 175-ft. long paved access driveway through the shoreline environment, and limited removal of existing trees and vegetation as necessary. ADDITIONAL PERMITS REQUIRED: WDFW Hydraulic Approval. STUDIES REQUIRED: None. LOCATION: The project site is presently an approximately 0.16-acre portion of Parcel #17-0760-000. (If further subdivision of the subject parcel occurs, it is presumed that the project site will become known as Lot 5 of Grove Estates Phase Two.) The subject area is located in the Cascade Valley area of Moses Lake, WA, approximately 0.28 miles southwest of the intersection of Valley Road NE and Grove Road NE, and approximately 0.12 miles south of the intersection of Grove Road NE and Elgin Road NE, and in the SE quarter of Section 20, Township 19 North, Range 28 East, WM, Grant County, WA. SHORELINE ENVIRONMENT: Suburban. PRESENT ZONING: Urban Residential 2. PUBLIC HEARING: None. CONSISTENCY STATEMENT: This proposal is subject to and shall be consistent with Grant County Code, International Building Code, and International Fire Code.
