NOTICE IS HEREBY GIVEN that the undersigned Trustee, JEREMY S. HUBERDEAU, Attorney at Law, will on October 31, 2014 at the hour of 10:00 a.m., at the Grant County Courthouse, main door, inside lobby, 35 C. Street NW, in the City of Ephrata, State of Washington, sell at public auction to the highest and best bidder, payable at the time of sale, the following described real property, situated in the County of Grant, State of Washington, to wit:

That portion of Lots 6 and 7, Block 4, North Ephrata Industrial Tract No. 1, according to the plat thereof recorded in Volume 6 of Plats, page 8, described as follows:

Beginning at the Brass Cap marking the quarter corner between Sections 10 and 11, Township 21 North, Range 26, EWM, Grant County, Washington; thence on a bearing of North 55°16’07” West, for a distance of 1,744.73 feet; thence on a bearing of North 50°51’24” West along the Easterly boundary of Lot 9, Block 4 North Ephrata Industrial Tract No. 1, according to the plat thereof recorded in Volume 6 of Plats, page 8, records of Grant County, Washington, for a distance of 200 feet to an intersection with the Southerly right of way line of Washington State Highway No. 28; thence along the Southerly right of way of State Highway No. 28, on a bearing of South 39°08’36” West, for a distance of 100 feet to the true point of beginning; thence continuing along said Southerly right of way line on a bearing of South 39°08’36” West, for a distance of 75 feet; thence on a bearing South 50°51’24” East, for a distance of 120 feet; thence on a bearing North 39°08’36” East for a distance of 75 feet; thence on a bearing of North 50°51’24” West for a distance of 120 feet to the true point of beginning.

(commonly known as 1246 Basin St NW, Ephrata, Washington), which is subject to that certain Deed of Trust, dated December 11, 2006 and recorded on December 13, 2006, under Auditor's File No. 1205416, records of Grant County, Washington, from EDWARD LEE MATTSON and ARLINE KAY MATTSON, husband and wife, as Grantor to secure an obligation in favor of PAUL JONES, as Beneficiary. JEREMY S. HUBERDEAU, Attorney at Law, was appointed as Successor Trustee by instrument recorded April 3, 2014, under Auditor’s File No. 1331088 by Beneficiary

II.

No action commenced by the Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any Court by reason of the Borrower's or Grantor's default on the obligation secured by the Deed of Trust.

III.

The Default for which this foreclosure is made is as follows: Failure to pay when due the following amounts, which are now in arrears:

Payments:

Failure to pay the entire balance of the promissory note together with any and all interest accrued thereon which became due and payable in full on December 5, 2011. There is currently an unpaid principal balance of $64,394.00.

Unpaid Balance due 12/5/2011: $64,394.00

Late Fees Due (as of 07/25/2014): $1,980.00

Interest from 12/5/2011 thru 3/31/2014: $4,091.01

Default interest from 04/01/2014 thru 07/25/2014 $3,917.32

Costs and fees (estimate): $4,655.76

Total: (as of 07/25/2014) $79,038.09

IV.

The sum owing on the obligation secured by the Deed of Trust is: Principal Balance $64,394.00 together with interest as provided in the note or other instrument secured from December 5, 2011, and such other costs and fees as are due under the note or other instrument secured, and as are provided by statute.

V.

The above-described real property will be sold to satisfy the expense of sale and the obligation secured by said Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on 10/31/2014. The defaults referred to in paragraph III must be cured by the 10/20/2014 (11 days before the sale date)

to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time before the 10/31/2014 (the sale date), the default(s) as set forth in paragraph III are cured and the

Trustee's fees and costs are paid. The sale may be terminated any time before the 10/31/2014 by the Borrower or Grantor or the holder of any recorded junior lien or encumbrance paying the principal and interest plus costs, fees, and advances, if any, made pursuant to the terms of the obligation and/or deed of trust, and curing all other defaults.

by both first class and certified mail on 07/25/2014 proof of which is in the possession of the Trustee; and the Borrower and Grantor were personally served on 04/28/2014 with said written Notice of Default and/or the Notice of Default was posted in a conspicuous place on the real property described in paragraph I above, and the Trustee has in his possession proof of such service or posting.

VII.

The Trustee whose name and address is set forth below will provide in writing, to any person requesting it, a statement of all costs and fees due at any time prior to the sale.

VIII.

The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the Grantor of all their interest in the above-described property.

IX.

Anyone having any objections to this sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections, if they bring a lawsuit to restrain the sale, pursuant to R.C.W. 61.24.130. Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee's Sale.

NOTICE TO OCCUPANTS OR TENANTS

The purchaser at the trustee’s sale is entitled to possession of the property on the 20th day following the sale, as against the grantor under the deed of trust (the owner) and anyone having an interest junior to the deed of trust, including occupants who are not tenants. After the 20th day following the sale the purchaser has the right to evict occupants who are not tenants by summary proceedings under the unlawful detainer act, chapter 59.12 RCW. For tenant-occupied property, the purchaser shall provide a tenant with written notice in accordance with RCW 61.24.060.
