AMENDMENT OF PORT DISTRICT NO. 8 OF GRANT

COUNTY'S COMPREHENSIVE PLAN OF INDUSTRIAL

DEVELOPMENT AND PROPOSED SALE OF PROPERTY

WITHIN INDUSTRIAL DEVELOPMENT DISTRICT NO. 4

Port District No. 8 of Grant County (the “Port of Warden”) will hold a public hearing on March 18, 2014, at 5:00 p.m., or as soon thereafter as possible, at the Port office located at 201 South Ash, Warden, Washington, to receive public testimony on the proposed amendment of the Port of Warden's Comprehensive Plan of Industrial Development to declare the following described Parcel 1 as surplus to the Port of Warden's needs, to sell Parcel 1 to CHS, Inc. and to hear and determine the advisability of selling the following described Parcel 2 located within Industrial Development District No. 4 to CHS, Inc., for use as a fertilizer and chemical storage and distribution facility and associated uses; to wit

PARCEL 1:

That portion of the Northwest quarter of Section 16, Township 17 North, Range 30 East, W.M., County of Grant, State of Washington, as described as follows:

Commencing at a United States Bureau of Reclamation Brass Cap monument marking the northwest corner of the northwest quarter of said Section 16; thence South 89°05'20" East, coincident with the north boundary line of the said northwest quarter, a distance of 1104.38 feet to the westerly boundary of the railroad right of way as shown on the State of Washington, Department of Natural Resources, commercial Leasing Plat dated May 4, 1977; thence South 07°18'56" West, coincident with said railroad right of way, a distance of 33.40 feet, to the southerly right of way boundary for the Washington State Department of Transportation State Route 170; thence South 89°09'29" East, coincident with the said southerly right of way for State Route 170, a distance of 158.89 feet to the POINT OF BEGINNING;

That portion of the Northwest quarter of Section 16, Township 17 North, Range 30 East, W.M., County of Grant, State of Washington, as described as follows:

Commencing at a United States Bureau of Reclamation Brass Cap monument marking the northwest corner of the northwest quarter of said Section 16; thence South 89°05'20" East, coincident with the north boundary line of the said northwest quarter, a distance of 1100.66 feet; thence South 00°54'40" West a distance of 33.00 feet to the southerly right of way boundary for the Washington State Department of Transportation State Route 170; thence South 07°20'22" West a distance of 397.33 feet to the POINT OF BEGINNING;

Thence continuing South 07°20'22" West a distance of 1470.80 feet; thence North 82°27'34" West a distance of 447.72 feet; thence North 07°51'18" East a distance of 756.84 feet, to the beginning of a curve tangent to said course, said curve's radius point bears South 82°08'42" East a distance of 470.00 feet; thence northerly and northeasterly on a 470.00-foot radius curve concave to the southeast a distance of 317.82 feet, coincident with the arc of said curve through a central angle of 38°44'40" to the right, the long chord of said curve bears North 27°13'38" East a distance of 311.80 feet; thence North 46°35'58" East, tangent to the aforementioned curve, a distance of 340.06 feet; thence North 46°35'58" East a distance of 116.24 feet, to the beginning of a non-tangent curve whose radius point of said curve bears North 43°21'29" West a distance of 530.00 feet; thence northeasterly on a 530.00-foot radius curve concave to the northwest a distance of 80.49 feet, coincident with the arc of said curve through a central angle of 8°42'06" to the left, the long chord of said curve bears North 42°17'28" East a distance of 80.42 feet, to the POINT OF BEGINNING;

Containing 12.044 ACRES, more or less.

Public testimony on the proposed Amendment of the Comprehensive Plan to declare Parcel 1 as surplus and to sell the same to CHS, Inc. and the proposed sale of Parcel 2 to CHS, Inc. shall be taken at the hearing. Any person may submit written comments regarding the proposals or obtain a map or additional information at Port of Warden, 201 South Ash, Warden, Washington. Written comments and oral testimony at all public hearings shall be made part of the public record.
