Notice of Application and Proposed Mitigated Determination of Non-Significance

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA Checklist received by Grant County on November 25, 2013 from Mick B. Hansen (Designated Contact: John Hermann, CBMI, 3740 Thayer Rd. NE, Moses Lake, WA 98837, 509-989-4318) were found to be technically complete on February 5, 2014.

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA Checklist received by Grant County on November 25, 2013 from Mick B. Hansen (Designated Contact: John Hermann, CBMI, 3740 Thayer Rd. NE, Moses Lake, WA 98837, 509-989-4318) were found to be technically complete on February 5, 2014. Grant County expects to issue a Mitigated Determination of Non-Significance for this proposal, and the Optional DNS Process in WAC 197-11-355 is being used. This proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. This may be the only opportunity to

comment on the environmental impacts of the proposal and the proposed mitigation measures. A copy of the subsequent threshold determination may be obtained upon request. PROPOSED MITIGATION MEASURES: 1. Proper erosion and sediment control practices must be used to prevent upland sediments from entering surface water. The landowner/applicant shall take all measures as necessary to minimize and control sediment run-off into Moses Lake during construction and/or after completion of this project, including, but not limited to: (a) Use of silt fences in conjunction with bales of hay to prevent and/or lessen soil erosion, (b) Replant disturbed soils with native vegetation following construction, (c) Consult with the WA Dept. of Fish and Wildlife (Ephrata Office) in order to determine the best methods and/or processes of erosion control, (d) Any excavated material(s) must be deposited landward of the shoreline and/or removed from the subject parcel, thereby lessening sedimentation and erosion, (e) Any rocks moved during construction of the dock, or during installation of the boatlift, must be deposited underneath the dock thereby enhancing hhabitat for native wildlife. 2. The landowner/applicant shall alter the shoreline only to the minimum extent necessary so as to complete the project as proposed. 3. The amount of shoreline altered and/or wetland vegetation disturbed by construction activities shall be kept to the minimum extent necessary in order to complete the project. Upon completion of the project, any/all disturbed areas shall be replanted with native wetland, aquatic, and/or terrestrial species as approved by the WA Dept. of Fish and Wildlife. 4. All proposed development at or below the Ordinary High Water Mark (OHWM) of Moses Lake shall be done during the annual draw-down (when the water level is low enough to allow work with minimal disturbance of lands below the OHWM). PROJECT: This proposal is for the construction of a 20-ft. wide x 40-ft. long cantilevered and floating U-shaped dock and installation of a freestanding 10-ft. x 16-ft. boatlift. This proposal also includes the removal of a weather/water-damaged existing log bulkhead, and the construction of a new concrete bulkhead in its place. The new bulkhead will be approximately 100 ft. long on the subject parcel, and will consist of an 8-in. wide x 7-ft. tall concrete retaining wall resting on a 5’-9” wide x 1-ft. tall concrete footing. Rocks will be added to slope from the lakebed up to within approximately 3 ft. from the top of the retaining wall. The scope of this proposal also includes a 24-ft. x 24-ft. x 4-in. thick concrete slab area for winter storage of the floating portion of the dock, removal of existing trees, removal of two existing steel terrace walls, and removal of an existing root cellar. This proposal will also permit modification of an existing access path through the shoreline environment from the upper elevation portion of the property down to the dock area. ADDITIONAL PERMITS REQUIRED: WDFW Hydraulic Approval. STUDIES REQUIRED: None. LOCATION: The site address of the subject parcel is 2133 Westshore Drive NE, Moses Lake, WA. It is known as Tax #3726 in Tract 54 of Stade Orchard Tracts Replat. The site is located approximately 1 mile north of the intersection of Interstate 90 and Hansen Road NE, and approximately 0.15 miles north of the intersection of Mae Valley Road NE and Westshore Drive NE, and in the SE quarter of Section 19, Township 19 North, Range 28 East, WM, Grant County, WA (Parcel #14-1766-000). SHORELINE ENVIRONMENT: Suburban. PRESENT ZONING: Urban Residential 2. PUBLIC HEARING: None. CONSISTENCY STATEMENT: This proposal is subject to and shall be consistent with Grant County Code, International Building Code, and International Fire Code.
