GIVEN that a petition filed September 6, 2013, with the Board of Directors Columbia Basin Irrigation District by Marvin Klinker, the holder of title described, praying that the following described land be included the South Half of Section 19, Township 14 North, Range 29 East, Washington, described as follows:

Southwest corner of Section 19, Township 14 North, Range 29 East, W.M.; East a distance of 2,222.60 feet to the True Point of Beginning; West a distance of 404.00 feet; thence North 28° 36’ 28” East a thence North 88° 45’ 09” East a distance of 704.50 feet; thence to a point which is the Northwest corner of the South Half of the Southeast Quarter; thence East along the North line of said South Quarter of the Southeast Quarter to the East line of said Southwest Southeast Quarter; thence South along said East line to the South right-Columbia Basin Irrigation District Canal No. WB-10-A; thence South right-of-way line to the South line of said Section; thence line to the True Point of Beginning. Excepting therefrom the following Southwest Quarter of the Southeast Quarter of Section 19, Township East, W.M., Franklin County, Washington, described as follows:

Southeast corner of Section 19, Township 14 North, Range 29 East, W.M.; 09” West a distance of 1,315.47 feet along the South boundary of Point of Beginning; thence North 00° 39’ 16” West a distance of 435 45’ 09” West a distance of 500 feet; thence South 00° 39’ 16” East a point on the South boundary of Section 19; thence North 88° of 500 feet along the South boundary of Section 19, to the True Southwest Quarter of the Southeast Quarter of Section 19, Township East, W.M., Franklin County, Washington, described as follows:

Southeast corner of Section 19, Township 14 North, Range 29 East, W.M.; 09” West a distance of 1,315.47 feet along the South boundary of Point of Beginning; thence North 00° 39’ 16” West a distance of 435 45’ 09” West a distance of 500 feet; thence South 00° 39’ 16” East a point on the South boundary of Section 19; thence North 88° of 500 feet along the South boundary of Section 19, to the True East Half of Section 19, Township 14 North, Range 29 East, W.M., Wahluke Branch Canal, in Franklin County, Washington, EXCEPT Southeast Quarter of the Southeast Quarter lying Southwesterly of the Irrigation District Canal No. WB-10-A right-of-way.

Township 14 North, Range 29 East, W.M., EXCEPT portion of Farm Unit Columbia Basin Project, Washington, according to the Farm Unit in Franklin County on August 6, 1957; ALSO EXCEPT that portion of the Northeast Quarter lying Northerly of the centerline of the as shown on the Farm Unit Plat of Irrigation Block 201, as recorded July 28, 1959; ALSO EXCEPTING all that portion of the Northwest the Wahluke Branch Canal; ALSO EXCEPT that portion conveyed Railway Company under Auditor’s File No. 311585 as follows:

Half of the Northwest Quarter of Section 20, said Township and feet from said centerline and Northeasterly of the right-of-way of Company as described in easement recorded in Volume 124 of Auditor’s File No. 272974, records of Franklin County, Washington; of the Northwest Quarter of the Northeast Quarter and the South Quarter of Section 20 lying within 50 feet from said centerline and right-of-way. Said centerline is described as follows:

1328+57.7 ahead, a point in the East line of Section 20, Township East, W.M., distant 2,069.5 feet North from the Southeast corner of North 51° 23’ 20” West 1,898.3 feet to a point of curve at Station 1132+00 ahead; thence Northwesterly on a 0° 30’ curve to the right tangent at Station 1138+00; thence Northwesterly on said tangent intersects the West line of Section 17, said Township and Range at a feet North from the Southwest corner of said Section 17) 3,829 feet Station 1176+29; thence Westerly on a 2° curve to the left 1,650.8 feet Station 1192+79.8; thence Westerly on said tangent; EXCEPTING the Northeast Quarter of Section 20, Township 14 North, Range particularly described as follows:

corner common to Sections 16, 17, 20, and 21 of Township 14 W.M.; thence on a bearing of South and East 1,376.58 feet to the property, which is the true North 1/16 corner of Sections 20 and Range 29 East; thence on a bearing of South 89° 56’ 25” West a to the Southwest corner of property; thence on a bearing of North 19° 52’ 50” West a distance of 658.55 feet to a corner on West boundary of property; thence on a bearing of North 00° 14’ 07” West a distance of 279.54 feet to the Northwest corner property, which is a point in center of existing Wahluke Branch Canal; thence on a bearing of South 59° 22’ 00” East a distance of 337.06 feet to an angle point on North boundary property, which is centerline of Wahluke Branch Canal; thence on a bearing of South 58’ 08” East a distance of 176.99 feet to the Northeast corner of property and is Section point of existing Wahluke Branch Canal, which has 125 feet of right-of-way on South canal from the Northwest corner of said property to the Northeast corner of said property; thence on a bearing of North 00° 14’ 07” West a distance of 704.50 feet to the True Point of Beginning of Travers, which is the Northeast corner of Section 20, Township 14 North, Range 29 East, W.M.; AND ALSO EXCEPT that portion of the Northeast Quarter of Section 20, Township 14 North, Range 29 East, W.M., described as follows:

Beginning at the Northeast corner of Section 20, Township 14 North, Range 29 East, W.thence South 00° 14’ 07” East a distance of 704.50 feet to a point hereby designated True Point of Beginning; thence South 00° 14’ 07” East a distance of 672.08 feet; thence South 89° 56’ 25” West a distance of 235.60 feet; thence North 19° 52’ 50” West a distance of 658.55 feet; thence North 00° 14’ 07” West a distance of 279.54 feet; thence South 22’ 00” East a distance of 337.06 feet; thence South 71° 58’ 08” East a distance of 176.99 feet, more or less, to the True Point of Beginning. AND ALSO EXCEPT that portion of 20, Township 14 North, Range 29 East, W.M., in Franklin County, Washington; Point of Beginning of said acreage is the true one-quarter corner monument on the boundary of Section 20, Township 14 North, Range 29 East, W.M.; thence on a bearing North 00° 14’ 07” West a distance of 1,320.4 feet along the East boundary of said Section; thence on a bearing South 89° 56’ 25” West, a distance of 69.50 feet; thence South 08° 54” West a distance of 1,134.18 feet; thence South 51° 23’ 00” East a distance of 320 to the True Point of Beginning.

EXCEPT that portion deeded to Franklin County, Washington, for road purposes under Auditor’s File No. 1560769.

All persons interested in or that may be affected by such inclusion of the land described above are hereby notified to appear at the office of the Board at 1135 E. Hillsboro, Suite A, Pasco, Franklin County, Washington, at 10:00 a.m., October 10, 2013, this being the regular meeting of the Board next after the last date of publication of this Notice of Hearing, and show cause in writing, if any they have, why such land should not be included within the District as prayed for in the petition.
