Notice of Application and Proposed Mitigated Determination of Non-Significance

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA Checklist received by Grant County on February 14, 2013 from Darrell & Marianne Brunner (Designated Contact: Eldon Broughton, 2403 Westshore Drive NE, Moses Lake, WA 98837, 509-750-9051) were found to be technically complete on March 13, 2013.

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA Checklist received by Grant County on February 14, 2013 from Darrell & Marianne Brunner (Designated Contact: Eldon Broughton, 2403 Westshore Drive NE, Moses Lake, WA 98837, 509-750-9051) were found to be technically complete on March 13, 2013. Grant County expects to issue a Mitigated Determination of Non-Significance for this proposal, and the Optional DNS Process in WAC 197-11-355 is being used. This proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. This may be the

only opportunity to comment on the environmental impacts of the proposal and the proposed mitigation measures. A copy of the subsequent threshold determination may be obtained

upon request. PROPOSED MITIGATION MEASURES: 1. Proper erosion and sediment control practices must be used to prevent upland sediments from entering surface water. The landowner/applicant shall take all measures as necessary to minimize and control sediment run-off into Moses Lake during construction and/or after completion of this project, including, but not limited to: (a) Use of silt fences in conjunction with bales of hay to prevent and/or lessen soil erosion, (b) Replant disturbed soils with native vegetation following construction, (c) Consult with the WA Dept. of Fish and Wildlife (Ephrata Ooffice) in order to determine the best methods and/or processes of erosion control, (d) Any excavated material(s) must be deposited landward of the shoreline and/or removed from the subject parcel, thereby lessening sedimentation and erosion, (e) Any rocks moved during construction for the placement of support legs for the dock must be deposited underneath the dock thereby enhancing habitat for native wildlife. 2. The landowner/applicant shall alter the shoreline only to the minimum extent necessary so as to complete the project as proposed. 3. The amount of shoreline altered and/or wetland vegetation disturbed by construction activities shall be kept to the minimum extent necessary in order to complete the project. Upon completion of the project, any/all disturbed areas shall be replanted with native wetland, aquatic, and/or terrestrial species

as approved by the WA Dept. of Fish and Wildlife. PROJECT: This proposal is for the construction of a 6-ft. wide x 15-ft. long freestanding walkway connecting to a 10-ft. wide x 20-ft. long freestanding dock. The overall length of both structures combined will be 35 feet. This proposal also includes a 4-ft. wide x approximately 50-ft. long natural surface access path through the shoreline environment. ADDITIONAL PERMITS REQUIRED: WDFW Hydraulic Approval. STUDIES REQUIRED: None. LOCATION: The site address of the subject parcel is 8306 Diamond Point Circle NE, Moses Lake, WA. The subject parcel is also known as Lot 14 of Diamond Point Plat. It is located in the Cascade Valley area of Moses Lake, WA, approximately 0.17 miles SE of the intersection of Valley Road NE and Diamond Point Circle NE, and in the NW quarter of Section 28, Township 19 North, Range 28 East, WM, Grant County, WA (Parcel #12-0136-514). SHORELINE ENVIRONMENT: Suburban. PRESENT ZONING: Urban Residential 2. PUBLIC HEARING: None. CONSISTENCY STATEMENT: This proposal is subject to and shall be consistent with Grant County Code, International Building Code, and International Fire Code.
