NOTICE OF APPLICATION FOR CHANGE OF GROUNDWATER

CERTIFICATE G3-01400C

TAKE NOTICE:

J. R. Simplot Company has made an APPLICATION FOR CHANGE/TRANSFER of Water Right to add points of withdrawal for Groundwater certificate G3-01400C to the Board. The Board has designated such application for active Board review assigning it a number of GRAN-12-07. The Department of Ecology has assigned tracking number CG3-1400C to this application.

That Ground Water Certificate G3-01400C with a priority date of September, 10 1960 has current authorization for the diversion of up to 1000 gallons per minute, 1,249 acre-feet per year, year round from groundwater. The place of Industrial use being 36.6 acres within the S1/2SW1/4 of Sec. 16,T. 19N.,R. 29 E,W.M.; in Grant County. The place of Irrigation use being approximately 455 acres within Section 22, T. 19N, R.29 E, W.M.; in Grant County. The point of withdrawal is from wells: Well AEH-393 and Well AEH-394 both of which are located within the SW1/4SW1/4 Section16 all within T19N, R29E, W.M.

The proposed change is to add two new points of withdrawal, for all authorized water. The New points of withdrawal will be within: SW1/4SW1/4 Section 16 within T19N, R29E, W.M. There will be no changes in the total amount of authorized water, the purposes of use or places of use.

Any interested party may submit comments, objections, and other information to the Board regarding this application. The comments and information may be submitted in writing or verbally at any public meeting of the board held to discuss or decide on the application. Additionally, the Board will consider written comments or information provided within thirty (30) days from the last date of publication of this notice, said written comments or information to be provided to its office located 1525 Wheeler Road, Moses Lake, WA 98837.

Any protests or objections to the approval of this application may be filed with the Department of Ecology and must include a detailed statement of the basis for objections. Protests must be accompanied by a fifty dollar ($50.00) recording fee and filed with the Cashiering Section, State of Washington, Department of Ecology, PO Box 47611, Olympia WA 98504-7611 within thirty (30) days from February 14, 2013.
