NOTICE OF APPLICATION FOR CHANGE/TRANSFER OF GROUNDWATER

TAKE NOTICE:

Segale Properties LLC of Tukwila, Washington has made an APPLICATION FOR CHANGE/TRANSFER of Water Right to change Groundwater Certificate Number G3-28949C to the Board.  The Board has designated such application for active Board review, assigning it a number of GRAN-11-22.  The Department of Ecology has assigned tracking number CG3-28949C@2 to this application.

That Ground Water Certificate Number G3-28949C with a priority date of February 7, 1991 has a current authorization for 800 gallons per minute, 280 acre-feet per year, for seasonal irrigation of 80 acres within E1/2NW1/4 of Section 26, T21N, R24E, Grant County, Washington from two wells, the points of withdrawal are well 1 within the NE1/4NW1/4, and well 2 within the SE1/4NW1/4, both of said section.

The proposed change is to change the place of use, location of the points of withdrawal and to add one well for a portion of the water rights comprising 35 acres, 122.5 acre-feet and 350 gpm (collectively, the “Transferred Water Rights”).  The Transferred Water Rights will be used within a new place of use that is 90 acres, and is more particularly described as the north half and the north 165 feet of the south half of the NE1/4 of Section 19, T17N, R28E, W.M.  The new points of withdrawal will be three wells; Well 1 [existing] within SE1/4NE1/4 of Section 20, T17N, R28E, W.M., Well 2 [existing] within NE1/4NW1/4 of Section 20, T17N, R28E, W.M., and Well 3 to be drilled within NW1/4NE1/4 of Section 19, T17N, R28E, W.M.  The authorized Purpose of Use will remain the same, and the number of acres that can be irrigated within the new place of use pursuant to the Transferred Water Rights shall be limited to the transferred 35 acres.  The remainder of the water rights, comprising 45 acres, 157.5 acre-feet and 450 gpm, which are not the subject of this change application shall remain on the existing property.

Any interested party may submit comments, objections and other information to the Board regarding this application.  The comments and information may be submitted in writing or verbally at any public meeting of the Board held to discuss or decide the application.  Additionally, the Water Conservancy Board will consider written comments or information provided within thirty (30) days from the last date of publication of this notice, said written comments or information to be provided to its office located at 1525 E. Wheeler Road, Moses Lake, Washington 98837.

Any protests or objections to the approval of this application may be filed with the Department of Ecology and must include a detailed statement of the basis for objections.  Protests must be accompanied by a fifty dollar ($50.00) recording fee and filed with the Cashiering Section, State of Washington, Department of Ecology, P.O. Box 47611, Olympia, Washington 98504-7611 within thirty (30) days from March 7, 2012.
