Grant County opposes lawsuit

in Grant County Superior Court. Coxon is suing Grant County and

Grant Mental Healthcare.

The response was to Gemini Coxon's medical malpractice lawsuit in Grant County Superior Court. Coxon is suing Grant County and Grant Mental Healthcare.

The woman is claiming a Grant Mental Healthcare nurse practitioner acted without consulting her when he allegedly gave her husband, David Coxon, "an excess of toxic medication." The type of medication was not included in the complaint.

Gemini Coxon claims an agreement existed between her and the agency that she would control the amount of medication her disabled husband received. When she came home in April 2007, she found her husband in a stupor. He was unresponsive and died shortly after he was discovered, according to the complaint.

Moberg's response denied all of Gemini Coxon's allegations, including stating that no agreement existed between Gemini Coxon and Grant Mental Healthcare.

"Gemini Coxon may have independently assumed the responsibility for monitoring the consumption of David Coxon's medications," according to the response.

Gemini Coxon is asking for a judgment to include David Coxon's lost earnings, the cost of funeral expenses and payment for pain and suffering and the loss of the enjoyment of life, according to the complaint. No dollar amount was listed.
