NOTICE IS HEREBY GIVEN THAT AN OPEN RECORD PUBLIC HEARING WILL

BE HELD November 22, 2010 at 1:30 p.m.      in the Grant County

Commissioners Hearing Room, Courthouse, Ephrata, WA to consider an

Ordinance amending Ch. 6.20 of the Grant County Code cited as

“Disorderly Conduct”.

NOTICE IS HEREBY GIVEN THAT AN OPEN RECORD PUBLIC HEARING WILL BE HELD November 22, 2010 at 1:30 p.m.      in the Grant County Commissioners Hearing Room, Courthouse, Ephrata, WA to consider an Ordinance amending Ch. 6.20 of the Grant County Code cited as “Disorderly Conduct”. The Ordinance would change the title to “Offenses against Public Peace” and would add the following sections:

66.20.030 Provoking assault defined.

A person provokes assault when he or she willfully provokes or attempts to provoke, by word, sign or gesture, another person to commit an assault or breach of the peace.

6.20.040 Violation – Penalty – Provoking assault.

Provoking Assault is a gross misdemeanor offense and any person who is convicted of a violation of this code shall be punished as follows: (1) By imprisonment for not less than ten days nor more than one year in jail. (2) Upon request from the defendant the court may convert jail time to community service hours with each individual day of jail sentenced being equal to eight hours of community service. (3) Such sentence must run consecutive to any other sentence.

6.20.050 Chapter Cumulative

The provisions of this chapter are not intended to repeal any other ordinance or statute involving the same subject matter.
