MITIGATED DETERMINATION OF NONSIGNIFICANCE (MDNS)

Description of proposal Proposal is to construct a 120 foot self supporting lattice tower for the

purpose of installing emergency communication equipment together

with supporting equipment shelter to be located on a concrete pad in a

fenced enclosure.

Location of proposal: The project is located on City of Warden property adjacent to an existing

water storage tower on Beck Way. Parcel # 60660000

Lead Agency: City of Warden

Threshold Determination:

The lead agency for this proposal has made a determination that this proposal does not have a probable significant adverse impact on the environment subject to conditions of approval. An environmental impact statement (EIS) is not required under RCW 43.21C.030 (2) (c). This decision is made after review of the completed environmental checklist and other information on file with the lead agency. The City of Warden has determined that this proposal will likely not have a probable significant adverse impact on the environment and issues this Determination of Non-

This MDNS is issued under 197-11-340(2) and 197-11-350.

The appeal period for this determination ends at 5:00pm March 31. 2010.

The following conditions address and provide for anticipated mitigation of impacts that may result from the construction of this proposal based on review of the environmental checklist allowing a Mitigated Determination of Non-Significance to be issued The conditions are based on the goals, policies and criteria established in the City of Warden Comprehensive Plan, and Zoning Ordinance As authorized by WAC 197-11-350, these conditions are incorporated as part of the environmental review and resulting MDNS, and must be complied with prior to commencing operations.

Conditions:

1. The applicant shall obtain all necessary permits, including building permits from the City of

Warden prior to any construction on site.

2. The tower will not be allowed to have white strobe lights (day light hours included) Should such lighting be required by the FAA the tower height shall be reduced to the height where white strobe lights would not be required. Steady red beacons or blinking red beacons are allowed but should be shielded from nearby properties to the greatest extent possible.

3. All proposals of the applicant contained within their application on file with the City of

Warden shall be considered conditions of approval.

4. Testing of any backup generator shall only be conducted during daylight hours on weekdays and shall not commence before the hour of 7 am and shall be completed before the hour of 5 pm. No testing shall be done on Saturdays or Sundays.
