NOTICE OF APPLICATION FOR CHANGE OF GROUNDWATER

CERTIFICATE G3-*01018C

TAKE NOTICE:

H&R Partnership of Moses Lake has made an APPLICATION FOR CHANGE/TRANSFER of a Water Right to change the point of withdrawal and transfer the place of use for portions of Groundwater Certificate G3-*01018C to the Board. The board has designated such application for active Board review assigning it a number of GRAN-08-08. The Department of Ecology has assigned tracking number CG3-*01018S@.

That Ground Water Certificate G3-*01018C with a priority date of October 15, 1948 has authorization for 1,200 gallons per minute, 337.5 acre-feet, each year, for domestic supply and the irrigation of 75.0 acres. The place of use being the South 75.0 acres of SW ¼ of Section 12, T. 19N., R. 27E., W.M. Area of authorized use is comprised of Grant County Tax Parcels 121991000, 121992000, 121993000, 121994000, 121995000, 121996000, 161412007, 161412012, 121997000, and 161412014. The point of withdrawal being one well located within the SE1/4SW1/4 Section 12, T. 19 N., R. 27 E., W.M.

The proposed change is to divide G3-*01018C into Part A, B, C, D, E, F, G, and H for the purpose of memorializing the division of G3-*01018C due to the previous subdivision and sale of portions of the SW1/4 of Section 12, T. 19 N., R 27 E., W.M..

The new authorized place of use for G3-*01018C A, B, C, D, E, F, and G would retain 537.8 gallons per minute, 136.0 acre feet, each year, for domestic supply and the irrigation of up to 33.61 acres of presently irrigated lands within Tax Parcels 121991000 (Renee D. Wilson), 121992000 (Tony Pfluger), 121993000 Debra Cromer), 121994000 (Eugene Bazel), 121995000 (Stanley Laskowski), 121996000 (Mike Lewis), and 121997000 (William Wilson). The existing point of withdrawal for Parts A, B, C, D, E, F, and G will remain existing well No. 1 within the SE1/4SW1/4 Section 12, T. 19 N., R. 27 E., W.M.

The new authorized place of use for G3-*01018C (H) would be allocated 528.0 gallons per minute, 133.7 acre feet, for domestic supply and the irrigation of 33.0 acres of presently irrigated lands within Tax Parcels 161412007 (David Hubbard), 161412012 (Mickey West), and 161412014 (H&W Partnership). The authorized point of diversion for part H would be transferred to existing well No. 2 authorized under G3-*01019C 766D within the NE1/4SW1/4 of Section 12, T. 19 N, R. 27 E, W.M.

Any interested party may submit comments, objections, and other information to the board regarding this application. The comments and information may be submitted in writing or verbally at any public meeting of the board held to discuss or decide on the application. Additionally, the Water Conservancy Board will consider written comments or information provided within thirty (30) days from the last date of publication of this notice, said written comments or information to be provided to its office located 3953 Airway Drive N.E., Moses Lake, WA 98837.

Any protests or objections to the approval of this application may be filed with the Department of Ecology and must include a detailed statement of the basis for objections. The new authorized place of use for GS-*01019C Part B, C, D, and E would be allocated 277.0 gallons per minute, 79.0 acre feet, each year, for the irrigation of up to 19.5 acres of presently irrigated lands within Tax Parcels, 121998000 (Antonia Vargas), 121999000 (Richard Light), 311681000 (Peter Ciganda), and 311682000 (Richard Cornett). The existing point of diversion for G3-*01019C (B) would be transferred to existing well No. 1 within the SE1/4SW1/4 Section 12, T. 19 N., R. 27 E., W.M.

TRANSMISSION & DISTRIBUTION LINE AND SUBSTATION CONSTRUCTION AND MAINTENANCE

Application for Pre-Qualification of Contractors for electrical construction or improvement of an electrical facility (as described below):

Pursuant to RCW 54.04.085, Contractors wishing to be considered by Public Utility District No. 2 of Grant County, Washington for designation as a pre-qualified bidder for transmission and distribution line construction and maintenance, fiber-optic construction and maintenance, substation construction and maintenance, and wood pole ground line test and treatment, must submit an application. The application will be reviewed and approved prior to receiving Contract Bid documents. Completed applications must be received no later than October 16, 2009 for the 2010 construction year. The District is required to evaluate applications once a year.

NOTICE

The Washington Department of Fish and Wildlife intends to rehabilitate Harris, Dune, Sedge, Tern, and Beda, and Brookies Lakes a nd numerous, small unnamed ponds in the vicinity west of the Winchester Wasteway in Grant County between the dates of during the week of September 24-October 2, 2009.

The pesticide to be used is an organic, natural compound called rotenone. The pesticide and active ingredients to be used are powdered rotenone at 6.7-7.9% active ingredient and liquid rotenone at 5% active ingredient. The targeted total concentration of rotenone product in the water is less than or equal to 1 part per million. Lake rehabilitation involves the treatment of the water with rotenone to eradicate undesirable species of fish. The undesirable species of fish are pumpkinseed sunfish, bass, and crappie. These species have overpopulated the lakes and eliminated the desired trout fishery. Rotenone is non-persistent in the environment and not toxic to humans or livestock at levels used to eradicate fish.

Notices will be posted along the shorelines, public boat launches, and other areas of normal access to the water. Please obey the following use restrictions within the posted treatment area:

1) No fish can be taken and eaten from the lake during the treatment period.

2) Do not use water to irrigate crops during the treatment period.

3) Do not use as porable water source during treatment period.

4) Do not swim in the lake until the rotenone product is thoroughly mixed.

The above list details the water use restrictions applicable t o Harris, Dune, Sedge, Tern, Beda, and Brookies Lake s and numerous, small unnamed ponds in the vicinity for the duration of rotenone toxicity. Rotenone toxicity will persist for 2 to 8 weeks. Assays will be done to determine lake toxicity, and water use restrictions will be removed when the lake detoxifies.
