NOTICE OF MITIGATED DETERMINATION OF NON-SIGNIFICANCE

NOTICE IS HEREBY GIVEN that the City of Moses Lake issued Mitigated Determinations of Non-Significance (MDNSs) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following projects:

1. PerforMix Major Plat - Plat the existing PerforMix site into one lot of 4.89 acres. The proponent is PerforMix Nutrition Systems, Nampa, ID. The site is located at 3146 Road "N" NE, in the Heavy Industrial Zone.

2. Pioneer Commercial Park 4th Addn Major Plat - Subdivide 10 acres into 2 lots in the C-2 General Commercial Zone, and extend Pilgrim Street to connect with Clover Drive. The proponent is Pioneer Way Associates, Mercer Island, WA. The site is located south of the intersection of Pilgrim Street and Colonial Avenue, east of Moses Lake High School, and west of Clover Drive, legally described as Tax #9847.

After review of the completed environmental checklists and other information on file with the City of Moses Lake, the SEPA Responsible Official has determined that the proposals will not have a probable adverse impact on the environment if the stipulated mitigation is provided. Pursuant to WAC 197-11-340(2) the lead agency will not act on these proposals for 14 days from the date of determination. Comments on the MDNSs must be submitted by Oct. 13, 2009 to the Responsible Official.
