NOTICE OF APPLICATION TO CONSTRUCT AN AIR POLLUTION SOURCE

The State of Washington Department of Ecology (Ecology) has received an application to expand and upgrade air pollution sources consisting of construction/installation/operation of new silicon production reactors and silane gas plant, with support and emergency response equipment, and replacement of some air pollution control equipment. The application has been made by REC Solar Grade Silicon, LLC for their facility located at 3322 County Road "N" N.E., near Moses Lake, WA in Grant County. After all new and modified equipment is in operation, the facility will have six to eight times the current production capacity. After review of the Notice of Construction application and other information on file with the agency, Ecology has made a preliminary determination that this proposal will conform to all requirements as specified in Ch. 173-400 WAC and Ch. 173-460 WAC. Copies of the Preliminary Determination and other pertinent information are available for public review at Ecology, 4601 N. Monroe, Spokane, WA, 99205 and at the Moses Lake Building and Planning Department, 321 Balsam Street, Moses Lake, WA.

The City of Moses Lake, as State Environmental Policy Act lead agency for this project, under Ch. 197-11 WAC, has determined that it will not have a probable significant adverse impact on the environment. The city has issued a MITIGATED DETERMINATION OF NONSIGNIFICANCE (MDNS) for the project. Copies of the MDNS and Environmental Checklist are available at no charge from Ecology at the above Spokane address. The public is invited to comment on the project and/or DNS by submitting written comments within 30 days of this notice to Robert Koster at the above Spokane address. A public hearing has been scheduled for this project. The hearing will be held at the Best Western Lake Front Hotel, Ballroom, 3000 Marina Drive, Moses Lake, WA on April 16th, 2009. The hearing will start at 7:30 pm., preceded by a workshop hosted by REC at 5:30 pm and a presentation by the Department of Ecology at 6:30 pm. AN ORDINANCE AMENDING OTHELLO MUNICIPAL CODE

CHAPTER 13.08 ENTITLED "CRITICAL AREAS".

In accordance with RCW 35A.12.160, the following is a summary of Othello Ordinance No. 1291 passed by the City Council and approved by Mayor Shannon McKay on the 23rd day of March, 2009. The full text of this ordinance will be mailed, free of charge, to any person requesting a copy.

SUMMARY

This ordinance amends certain technical elements to Ordinance No. 1288, as submitted by the Department of Ecology.

REC Storage Pond: REC Silicon submitted an application for environmental review on Nov. 12, 2008. Additional required information was submitted March 12 & 23, 2009. The application was determined to be complete and ready for review on March 23, 2009. The proposal is to create a storage pond for 60 million gallons of non-contact cooling water. The water will be stored during the winter and used to irrigate crops in the summer. The site is located in the Heavy Industrial Zone, west of the existing REC plant at 3322 Road N, T#14,865 in FU 77, 78, & 79, Blk 41. The project has been determined to be consistent with the City's Comprehensive Plan, and the following development regulations are applicable to the project: Moses Lake Municipal Code (MLMC) Title 14: Environmental Review, Title 16: Buildings and Construction, Title 18: Zoning, and Title 20: Development Review Process.

Written comments on this proposal will be accepted until 5:00 p.m. on April 8, 2009. Persons who want to be informed of future actions, or the final decision, on this proposal should provide their name and address to the project planner. The final decision on this proposal will be made within 120 days of the date of the notice of completeness and may be appealed according to the City appeal provisions specified in MLMC 20.11, Appeals. LEGAL NOTICES

The Housing Authority of Grant County has modified the 2009 Capital Fund Program budget and the current 5-year Capital Fund Action Plan and has created a budget for the additional Capital Fund monies the Housing Authority received from the American Recovery and Reinvestment Act. The 2009, 2009S Capital Fund budgets and the 5-year Capital Fund 5-year Action Plan will be available for review at the Housing Authority office, located at 1139 Larson Boulevard in Moses Lake, until April 8, 2009 at 10:00 a.m. On that same date, at 12:45 p.m., a public hearing will be conducted by the Housing Authority Board of Commissioners to receive verbal comment on the Plan. The meeting will be at the Housing Authority office. Written comment will also be accepted if it is received no later than the day of the public hearing by 12:00 p.m. at the Housing Authority office.
