I.

NOTICE IS HEREBY GIVEN that the undersigned Trustee, Mitchell J. Heaps, will, on the 28th day of August, 2009, at the hour of 11:00 a.m., at 401 South Balsam Street, in the city of Moses Lake, State of Washington, sell at public auction to the highest and best bidder, payable at the time of sale the following described real property, situated in the county of Grant, state of Washington, to wit:

LOTS 22, 23 AND 24, BLOCK 4, THE ORIGINAL TOWNSITE OF WILSON CREEK, ACCORDING TO THE PLAT THEREOF RECORDED IN VOLUME 1 OF PLATS, PAGE(S) 22, RECORDS OF GRANT COUNTY, WASHINGTON.

(Tax Parcel Nos: 12-1340-000, 12-1339-000, 12-1341-000).

The address of said property is 213 Railroad St., Wilson Creek, Washington 98860.

which is subject to that certain Deed of Trust dated November 2, 2006, recorded November 16, 2006, under Auditor's File No. 1203880, records of Grant County, Washington, from JULIE A. GODFREY, as Grantor, to TRUSTEE SERVICES, INC., as Trustee, to secure an obligation in favor of LEON P. POWELL and MYRTLE MARIE POWELL, husband and wife, as Beneficiaries.

II.

No action commenced by the Beneficiaries of the Deed of Trust or the Beneficiaries' successor is now pending to seek satisfaction of the obligation in any court by reason of the Grantor's default on the obligation secured by the said Deed of Trust.

III.

The defaults for which this foreclosure is made are as follows:

Failure to pay when due the following amounts which are now in arrears:

(a) The monthly payments of Four Hundred Eighty Dollars and 00/100 ($480.00) due on January 1, 2009, and the monthly payment of Four Hundred Eighty Dollars and 00/100 ($480.00) due on the 1St of each month thereafter, including May, 2009: Total monthly payments due of Two Thousand Four Hundred and 00/100

Dollars {$2,400.00).

A late charge of Twenty-four and 00/100 Dollars ($24.00) due for each monthly payment specified in subparagraph (a): Total late charges of One Hundred Twenty and 00/100 Dollars ($120.00). Delinquent property taxes for 2009 in the amount of Five Hundred Ninety-Six and 22/100 Dollars ($596.22), plus interest and penalties.

(d) Delinquent governmental taxes, fees and assessments with the State of Washington, Department of Labor and Industries in the amount of One Thousand Sixty and 39/100 Dollars ($1,060.39) plus interest.

(e) Delinquent governmental taxes, fees and assessments with the State of Washington, Department of Revenue from January 1, 2007 through February, 2009, in the amount of Fourteen Thousand Seven Hundred Twenty-seven and 23/100 Dollars ($14,727.23) plus interest.

In summary, the total amount in arrears as described above is:

(a) Total of Monthly Payments Due: $ 2,400.00

(b) Total of Late Charges Due: $ 120.00

(e) Delinquent Property Taxes for 2009

(plus interest and penalties) $ 596.22

(d) Delinquent Governmental Taxes

In addition to the above-described defaults, the non-monetary defaults for which this foreclosure is made are as follows:

The failure to maintain and preserve the subject property.

The failure to maintain insurance coverage on the property.

The failure to provide the Beneficiary with annual operating statements pursuant to Paragraph 16 of the Deed of Trust.

IV.

The sum owing on the obligation secured by the Deed of Trust is: Principal of Fifty Four Thousand Eight Hundred Eighty-Nine and 16/100 Dollars ($54,889.16), together with interest as provided in the Note or other instrument secured from January 1, 2009 until May 31, 2009, and such other fees, costs, penalties, and advances as are due under the Note or other instrument secured, and as are provided by statute.

V.

The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on the 28th day of August, 2009. The defaults referred to in paragraph III must be cured by the 17th day of August, 2009 (11 days before the sale date), to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time on or before the 17th day of August, 2009, (11 days before the sale date), the defaults as set forth in paragraph III are cured and the Trustee's fees and costs are paid. The sale may be terminated any time after the 17t1i day of August, 2009 (11 days before the sale date), and before the sale by the Borrower, Grantor, any Guarantor, or the holder of any recorded junior lien or encumbrance paying the entire principal and interest secured by the Deed of Trust, plus costs, fees, and advances, if any, made pursuant to the terms of the obligation and/or Deed of Trust, and curing all other defaults.

A written notice of default was transmitted by the Beneficiary or Trustee to the Grantor or the Grantor's successor in interest at the following addresses:

by both first class and certified mail on the 19th day of May, 2009, proof of which is in the possession of the Trustee; and the written notice of default was posted in a conspicuous place on the real property described in paragraph I above, and the Trustee has possession of proof of such service or posting.

VII,

The Trustee whose name and address are set forth below will provide in writing to anyone requesting it,

a statement of all costs and fees due at any time prior to the sale

VIII,

The effect of the sale will be to deprive the Grantor and all those who hold by, through or under the

Grantor of all their interest in the above-described property.

IX.

Anyone having any objection to the sale on any grounds whatsoever will be afforded an opportunity to be heard as to those objections if they bring a lawsuit to restrain the sale pursuant to RCW 61.24.130. Failure to bring such a lawsuit may result in a waiver of any proper grounds for invalidating the Trustee's sale.

X.

NOTICE TO OCCUPANTS OR TENANTS

The purchasers at the Trustee's Sale are entitled to possession of the property on the 20th day following the sale, as against the grantor under the deed of trust (the owner) and anyone having any interest junior to the deed of trust, including occupants and tenants. After the 20th day following the sale, the purchaser has the right to evict occupants and tenants by summary proceedings under the unlawful detainer act, Chapter 59.12 RCW.

PUBLIC NOTICE

Washington State Department of Ecology - Office of Columbia River, 303 S. Mission Street, Suite 200, Wenatchee, WA 98801, is seeking coverage under the Washington State Department of Ecology's Construction Stormwater General Permit.

The proposed project, Weber Siphon Complex, is located at the north and south sides of I-90 near Road U NE and SE, Washington in the Moses Lake area in Grant County, WA.

This project involves 68 acres of soil disturbance for irrigation system (siphon) construction activities. Stormwater will be discharged to ground surface infiltration. Construction dewatering water will be discharged to ground surface infiltration, however, some may indirectly discharge to Weber Coulee.

Any persons desiring to present their views to the Department of Ecology regarding this application, or interested in the Department's action on this application, may notify Ecology in writing within 30 days of the last date of publication of this notice.

LEGAL NOTICE

The Moses Lake Police Department is applying for monies through the Justice Assistance Grant. The money is intended for the purchase of camera equipment. The department is soliciting public input on the matter. If anyone is interested in providing comment, there will be a public meeting at the Moses Lake Police Department on August 4th, at 6pm.
