LAKESHORE & PENINSULA RECONSTRUCTION - 2009

Sealed bids will be received at City Hall, 321 South Balsam, (P. O. Box 1579), Moses Lake, Washington 98837 until July 23, 2009, 10:00 AM, for the above-named improvement. Said bids will be opened and publicly read at that time. All bids shall be received before said opening time in sealed envelopes with "LAKESHORE & PENINSULA RECONSTRUCTION - 2009" marked plainly thereon.

All bids shall be accompanied by a deposit in the form of a postal money order, cashier's check, or surety bond in an amount equal to 5 percent of the bid. Should the successful bidder fail to enter into a contract and/or to furnish a satisfactory contract bond within the time stated in the specifications, the deposit shall be forfeited to the City.

This project is subject to the Provisions of the American Recovery and Reinvestment Act of 2009 (ARRA) Employment Report. Failure by the Contractor to submit ARRA Employment Reports for the Contractor and all subcontractors of any tier shall be reason for withholding all progress payments until reports are received.

Copies of plans and specifications are on file at various construction councils and at City Hall and may be obtained for a non-refundable fee of $50.00 at the above address. Only bids from those who have purchased plans and specifications will be accepted per the special provisions.

The City of Moses Lake in accordance with Title VI of the Civil Rights Act of 1964, 78 Stat. 252, 42 U.S.C. 2000d to 2000d-4 and Title 49, Code of Federal Regulations, Department of Transportation, subtitle A, Office of the Secretary, Part 21, nondiscrimination in federally assisted programs of the Department of Transportation issued pursuant to such Act, hereby notifies all bidders that it will affirmatively insure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color or national origin in consideration for an award.

PROJECT DESCRIPTION: This project consists of reconstructing Peninsula Drive and Lakeshore Drive from the intersection of Peninsula Drive and Battery Road to the intersection of Lakeshore Drive and Pommer Street, approximately 5,250 L.F. The project work includes removal of BST roadway, some curb and sidewalk, removal of existing water meters, adjustment of existing manholes, monuments, and valves, removal of existing hydrants. The project also includes installation of 2,200 L.F. of 8" C900 PVC Water Main with fittings and valves, new hydrants, catch basins, infiltration trenches, 600 L.F. of 10@ PVC storm sewer main, water services, sewer services, 10,500 lineal feet of curb and gutter, 8,800 square yards of sidewalk and driveway, and 2,800 tons of HMA road surfaces. Project also includes reconstruction of an existing sewer pumping station including drywell modifications, new pumping vault, new electrical service, new controls and telemetry.

Estimated Project Cost: $1,180,000

The City Council reserves the right to reject any or all bids if such action is in the best interest of the City.

and Public Hearing

North American Foreign Trade Zone Industries LLC submitted an application for a major subdivision on June 24, 2009. The application was determined to be complete and ready for review on July 1, 2009. The proposal is to replat existing lots into 3 platted lots and extend Doolittle Drive to the east. Deviations related to driveways were also requested. The site is 17.32 acres located between Patton Blvd and the railroad tracks, north of Doolittle Dr, described as Lot 2 ASPI Commerce Park Major Plat and Tax #14,807 in Lot 1 of the North Gateway Center Binding Site Plan, parcel #12-2152-000 & 12-1956-940, in the C-2 General Commercial Zone. The project has been determined to be consistent with the City's Comprehensive Plan, and the following development regulations are applicable to the project: Moses Lake Municipal Code (MLMC) Title 14: Environmental Regulations, Title 17: Subdivisions, Title 18: Zoning, and Title 20: Development Review Process.

The Planning Commission will conduct a public hearing on August 13, 2009 at 7:00 p.m. in the City Council Chambers located at 411 Balsam Street. All interested persons are encouraged to attend and provide comment.

Written comments on the environmental impacts of this proposal will be accepted until 5:00 p.m. on July 17, 2009. Written comments on other aspects of this proposal will be accepted until 5:00 p.m. on the date of the public hearing. Persons who want to be informed of future actions, or the final decision, on this proposal should provide their name and address to the project planner. The final decision on this proposal will be made within 120 days of the date of the notice of completeness and may be appealed according to the City appeal provisions specified in MLMC 20.11, Appeals. NOTICE OF MITIGATED DETERMINATION OF

NON-SIGNIFICANCE

NOTICE IS HEREBY GIVEN that the City of Moses Lake issued Mitigated Determinations of Non-Significance (MDNSs) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following projects:

1. Lad Irrigation Major Plat - Consolidate 6 existing tax parcels into one platted lot of 8.72 acres. Add 4,564 sq. ft. of new retail sales area and 1,754 sq. ft. of new office space to the existing building. The proponent is Lad Irrigation, Moses Lake. The site is located at 1030 & 1040 E. Broadway in the Heavy Industrial Zone

2. 7th Day Adventist Church - Construct a 20,000 square foot church building and 50 new parking spaces adjacent to an existing private school at 1601 Valley Road in the R-1, Single Family Residential Zone. The proponent is Tektoniks Corp, Walla Walla.

After review of the completed environmental checklists and other information on file with the City of Moses Lake, the SEPA Responsible Official has determined that the proposals will not have a probable adverse impact on the environment if the stipulated mitigation is provided. Pursuant to WAC 197-11-340(2) the lead agency will not act on these proposals for 14 days from the date of determination. Comments on the MDNSs must be submitted by July 15, 2009 to the Responsible Official.
