NOTICE: Quincy Ground Water Subarea Licensees

As a reminder, landholders who either directly or indirectly own and/or lease land in the Subarea over the forms submittal threshold must file annual Reclamation Reform Act of 1982 (RRA) forms by March 15, 2009 to be eligible to receive Reclamation irrigation water. Forms will be accepted until March 16, 2009 as March 15 falls on a Sunday. This includes but is not limited to individuals, entities, trusts, estates, public entities, religious or charitable organizations, and farm operators. This is a westwide disclosure. Any and all land must be counted if it is in a district subject to the RRA.

Please contact the RRA staff in Boise, Idaho, toll free at 888-767-3850 if you have any questions about your submittal threshold or entitlements, what forms are required, or for any questions you may have about the forms.

RRA forms are to be submitted to the Bureau of Reclamation, Attn: PN-3327, 1150 N. Curtis Road, Suite 100, Boise, ID 83706-1234.

Reclamation's Boise RRA staff will be in the Ephrata Field Office on Wednesday, March 11, 2009 to collect 2009 RRA forms and answer basic questions. Separate notification regarding details will be sent to Subarea licensees that are required to file forms.

NOTICE OF APPLICATION FOR CHANGE/TRANSFER OF GROUNDWATER

CERTIFICATE G3-24811C

TAKE NOTICE:

The Washington State Department of Natural Resources, Southeast Region Office, Ellensburg, WA has made an APPLICATION FOR CHANGE/TRANSFER of Water Right to change the place of use for Groundwater Certificate G3-24811C to the Board. The Board has designated such application for active Board review, assigning it a number of GRAN-08-07. The Department of Ecology has assigned tracking number CG3-24811C to this application.

That Ground Water Certificate G3-24811C with a priority date of February 7, 1976 has a current authorization for 3,000 gallons per minute, 1,260 acre-feet per year, for the irrigation of 360 acres. The place of use is 360 acres within the N1/2, and that part of the N1/2N1/2S1/2 of Section 36, T21N, R24E, W.M. in Grant County, lying northerly of Irrigation Block 73. The points of withdrawal are two wells located in the NE¼SW¼ and NW¼SE¼ of Section 36, T21N, R24E, W.M. in Grant County respectively.

The proposed change is to increase the place of use acreage by changing the crop types and implementing water conservation methods. The amount of water available to spread will be determined through the Record of Examination process, which will be utilized to irrigate crops to be grown on the SE¼ of Section 26, T21N, R24E, W.M. in Grant County, currently owned by JPJ Family Enterprises. The spreading of water is authorized under RCW 90.03.380. There will be no points of withdrawal added, along with no change in the total amount of authorized water or purpose of use.

Any interested party may submit comments, objections, and other information to the Board regarding this application. The comments and information may be submitted in writing or verbally at any public meeting of the Board held to discuss or decide on the application. Additionally, the Water Conservancy Board will consider written comments or information provided within thirty (30) days from the last date of publication of this notice, said written comments or information to be provided to its office located at 3953 Airway Drive, Moses Lake, WA 98837.

Any protests or objections to the approval of this application may be filed with the Department of Ecology and must include a detailed statement of the basis for objections. Protests must be accompanied by a fifty dollar ($50.00) recording fee and filed with the Cashiering Section, State of Washington, Department of Ecology, PO Box 47611, Olympia WA 98504-7611 within thirty (30) days from February 10, 2009.

NOTICE OF MITIGATED DETERMINATION OF NON-SIGNIFICANCE

NOTICE IS HEREBY GIVEN that the City of Moses Lake issued a Mitigated Determination of Non-Significance (MDNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Westlake PUD - Create a 67-acre planned unit development consisting of 17 acres of commercial uses and 50 acres divided into 188 single-family residential lots. Commercial uses are in the C-2 General Commercial Zone and residential uses are in the R-1, Single-Family Residential Zone. The commercial area will be divided into seven parcels for a large retail store, hotel, strip mall, grocery store, gas station/convenience store, and 2 restaurants. The site is located north of North Frontage Road, west of Hansen Road, south of Fairway Drive, and east of the Moses Lake Country Club. Parcels are described as Tax #7080 in Government Lot 1 less Tax #8580 (11-0461-000), SENE, NESE west of Hansen Road (11-0065-200), and SESE north of highway (11-0065-201), all within S30-T19N-R28E.

After review of the completed environmental checklist and other information on file with the City of Moses Lake, the SEPA Responsible Official has determined this proposal will not have a probable adverse impact on the environment if the stipulated mitigation is provided. Pursuant to WAC 197-11-340(2) the lead agency will not act on this proposal for 14 days from the date of determination. Comments on the MDNS must be submitted by February 25, 2009 to the Responsible Official.
