I.

NOTICE IS HEREBY GIVEN that the undersigned Trustee, Larry W. Larson, will, on the 18th day of December, 2009, at the hour of 11:00 a.m., at 401 South Balsam Street, in the city of Moses Lake, State of Washington, sell at public auction to the highest and best bidder, payable at the time of sale the following described real property, situated in the county of Grant, state of Washington, to wit: LOT I, KIYOJPS SHORT PLAT, A REPLAT OF LOT 2, MELVA ADDITION NO.7, ACCORDING TO THE PLAT THEREOF RECORDED IN VOLUM E 2 OF SHORT PLATS, PAGES 67 AND 68, RECORDS OF GRANT COUNTY, WASHINGTON;

Tax Parcel No.: 31-1282-000; which is subject to that certain Deed of Trust dated December 20, 2002, recorded December 20, 2002, under Auditor's File No. 1115991, records of Grant County, Washington, from KIYOJI MIYAMOTO and CYNTHIA K. MIYAMOTO, husband and wife, as Grantors, to GRANT COUNTY TITLE COMPANY, as Trustee, to secure an obligation in favor of WILLIAM S. DRESS, as Beneficiary. The Deed of Trust was assigned and sold to DAVID BLACK, a single man, as Beneficiary, from WILLIAM S. DRESS, a single man.

LARRY W. LARSON is now Successor Trustee by reason of an Appointment of Successor Trustee, recorded on July 15, 2009, under Auditor's File No. 1257970, records of Grant County, Washington.

II.

No action commenced by the Successor Beneficiary of the Deed of Trust is now pending to seek satisfaction of the obligation in any court by reason of the Grantor's default on the obligation secured by the said Deed of Trust.

III.

The defaults for which this foreclosure is made are as follows:

Failure to pay when due the following amounts which are now in arrears:

(a) Principal due on December 20, 2005 in the amount of Two Hundred Fifty-Seven

Thousand One Hundred Sixty-Two and 29/100 Dollars ($257,162.29).

(b) Interest due in the amount of Two Hundred Forty-One Thousand Eighty-Nine

and 64/100 Dollars ($241,089.64) @ the default rate of 18% per annum from

7/1/04 through 9/15/09.

(c) Delinquent property taxes for 2003 through 2009 in the amount of Fifty-Nine Thousand

Eight Hundred Fifty-Four and 80/100 Dollars ($59,854,80), including interest and

penalties.

In summary, the total amount in arrears as described above is:

(a) Total Principal Due: $257,162.29

(b) Total Interest Due: $241,089.64

(c) Delinquent Property Taxes for 2003 - 2009

(including interest and penalties) $ 59,854.80

(d) Late charge: $ 15,558.11

Total Amount in Arrears: $573,664.84

In addition to the above-described defaults, the non-monetary defaults for which this foreclosure is made are as follows:

The sum owing on the obligation secured by the Deed of Trust is: Principal of Two

Hundred Fifty-Seven Thousand One Hundred Sixty-Two and 29/100 Dollars ($257,162.29), together with interest as provided in the Note secured from July 1, 2004 until September 15, 2009, and such other fees, costs, penalties, and advances as are due under the Note or other instrument secured, and as are provided by statute.

V.

The above-described real property will be sold to satisfy the expense of sale and the obligation secured by the Deed of Trust as provided by statute. The sale will be made without warranty, express or implied, regarding title, possession, or encumbrances on the 18th day of December, 2009. The defaults referred to in paragraph III must be cured by the 7th day of December, 2009 (11 days before the sale date), to cause a discontinuance of the sale. The sale will be discontinued and terminated if at any time on or before the 7t'1 day of December, 2009, (11 days before the sale date), the defaults as set forth in paragraph III are cured and the Trustee's fees and costs are paid. The sale maybe terminated any time after the 7th day of December, 2009 (11 days before the sale date), and before the sale by the Borrower, Grantor, any Guarantor, or the holder of any recorded junior lien or encumbrance by paying the entire principal and interest secured by the Deed of Trust, plus costs, fees, and advances, if any, made pursuant to the terms of the obligation and/or Deed of Trust, and curing all other defaults.

"PUBLIC NOTICE OF CONSTRUCTION INTENT"

The Washington State Department of Transportation, P.O. Box 98, Wenatchee, WA 98807, is seeking coverage under the Washington State Department of Ecology's NPDES General Permit for Stormwater Discharges Associated with Construction Activities. The proposed project, "West of Othello Passing Lane", is located on SR 26 from milepost 34.53 to 35.78, in the vicinity of Othello, WA. Approximately 5 acres will be disturbed to add an additional lane in this area.

Work on this project includes widening for the additional lane, utility relocations, and vegetation re-establishment.

Stormwater discharge will flow into roadside ditches and side slopes. Any treated stormwater not infiltrating on site will flow through a wetland/ditch area west of the project that consists of intermittent ponded water from irrigation operations and highway runoff.

Any person desiring to present their views to the Department of Ecology concerning this application may notify the Department of Ecology in writing within 30 days of the last date of publication of this notice (6/30/06). Comments may be submitted to:

Moses Lake Irrigation and Rehabilitation District

Capital Improvement Program

The Warden School District No. 146 - 161 requests interested architectural firms to submit written statements of qualifications (SOQ's) prior to 4:00 p.m. on Friday, December 11, 2009, for consideration in the selection of architectural and engineering design services for their proposed capital improvement program.

The scope of work will include, without limitation, the following:

o Pre-design services, including educational specification development;

o Budget development and tracking;

o Complete design services including architectural, structural, mechanical, electrical, and all other design services necessary;

o Development, submission and review of WA State SEPA or other environmental and regulatory documents as required.

o D-form development and processing;

o Project design and preparation of bid/contract documents;

o Coordinate general contractor procurement;

o Provide construction phase contract administration;

o Warranty compliance monitoring and assistance;

o Address and incorporate as appropriate specialty consultant input including value analysis, constructability, commissioning, and special inspection.

Interested architectural firms will submit information in response to the RFQ relating to K-12 experience, design and performance on relevant locker room and cafeteria modernization projects within Washington, responsiveness, coordination, supervision and production capability, personnel assigned to the project, ability to meet schedule and budget, references, and other factors that may be relevant to the Warden School District for this project.

Following review of the SOQ's by the selection committee all responding firms will be notified of the Board's selection. Immediately upon selection of the most qualified Architectural firm, the District will enter into fee negotiations with that firm. If fee negotiations become stalled or come to impasse, the firm will be dismissed and the District will proceed to conduct fee negotiations with the firm evaluated to be the next most qualified. This process will continue until fee negotiations are successfully completed and a contract is signed.

The District reserves the right to reject all Statements of Qualifications and the District reserves the right to waive minor irregularities in the selection process.

PROJECT/CONSTRUCTION MANAGEMENT SERVICES

The Warden School District No. 146 - 161 reserves the right to reject any and all SOQs and to waive any irregularities or informalities as may be deemed necessary in the best interest of the District.

SOQs shall be submitted no later than the time and date established in the RFQ documents. SOQs deemed late by the District will not be considered, and will be returned unopened.

The District will evaluate SOQs in order to determine the most advantageous firm(s) for the District. The District will use the following factors to evaluate SOQs, listed in order from most to least important: compatibility, experience and qualifications of the project staff and proposed project manager, management approach and methodology, specific qualifications and experience relating to the proposed work, previous experience and performance on other projects, especially education projects, experience with State of Washington public works projects and K-12 school facility construction, attitude, and interest.
