PUBLIC HEARING NOTICE

The Preliminary Budget for the 2009 fiscal year has been filed with the Finance Director. Copies of the preliminary budget may be examined and/or obtained at the Office of the Finance Director during normal business hours.

The City Council shall meet on November 11, 2008 at 7 p.m. in the Council Chambers and following a public hearing, shall consider the first reading of an ordinance adopting the 2009 budget. The City Council shall meet on November 25, 2008 at 7 p.m. in the Council Chambers and consider the second reading of an ordinance fixing and adopting the 2009 budget. Any taxpayer will have the right to appear and provide written and oral comments for or against any part of the budget and ask questions concerning the entire budget at the public hearing.

NOTICE OF APPLICATION TO LAND APPLY BIOSOLIDS

Express Septic has applied to the Washington state Department of Ecology (Ecology) for coverage under the statewide General Permit for Biosolids Management. Express Septic plans to pump, screen, land apply and soil incorporate septage, or treat and land apply septage to a site used to grow feed crops. It seeks to improve soils by adding septage-derived nutrients and organic matter. The proposed site is at 4480 Road N NE, Farm unit 55, Block 41, Parcel #190440001 located in Grant County, WA.

Future proposals for other sites may undergo environmental review. For future sites, Express Septic will provide notice in a newspaper circulated in the proposed area, and post notice at the site for 30 days.

Any persons wishing to comment on this proposal or desiring to present their views regarding this proposal to Ecology must do so, in writing, within 30 days of the date of newspaper publication of this notice. Address comments to Martyn Quinn, Ecology, at the address below.

Any person wishing to request a public hearing or meeting regarding this project this project must submit a written request to Martyn Quinn, Ecology, at the address below, within 30 days of the last date of newspaper publication of this notice. Carlos and Teresa Tyler submitted an application for conditional use permit on Sept. 29, 2008. The application was determined to be complete and ready for review on Oct. 10, 2008. The proposal is to extend the hours of operation for Jamison's, an event center located in the R-3 Multi-family residential zone at 605E. Nelson Road legally described as Lot 1, Monroe St. Reception Center Plat. The project has been determined to be consistent with the City's Comprehensive Plan, and the following development regulations are applicable to the project: Moses Lake Municipal Code (MLMC) Title 14: Environmental Regulations, Title 16: Buildings and Construction, Title 18: Zoning, and Title 20: Development Review Process.

Environmental review is required for this project. The City of Moses Lake has reviewed the proposed project for probably adverse environmental impacts and expects to issue a Determination of Non-Significance (DNS) for this project. The optional DNS process in WAC 197-11-355 is being used. This may be your only opportunity to comment on the environmental impacts of the proposed project. No conditions have been identified as being needed to mitigate adverse environmental impacts through SEPA. The project review process may include additional mitigation measures under applicable codes.

The Planning Commission will conduct a public hearing on Nov. 13, 2008 at 7:00 p.m. In the city council Chambers located at 401 Balsam Street. All interested persons are encouraged to attend and provide comment.

Written comments on the environmental impacts will be accepted until 5:00 p.m. on Oct. 28, 2008. Other written comment son the proposal will be accepted until 5:00 p.m. on the date of the public hearing. Persons who want to be informed of future actions, or the final decision, on this proposal should provide their name and address to the project planner. The final decision on this proposal will be made within 120 days of the date of the notice of completeness and may be appealed according to the City appeal provisions specified in MLMC 20.11, Appeals. SUMMARY

It allows the Planning Commission to grant a waiver for certain parking requirements within commercial zones and the building official shall determine the parking requirements for uses not defined in the ordinance.

REVENUE SOURCES FOR CITY'S 2009 CURRENT EXPENSE BUDGET

SETTING PROPERTY TAX LEVY

The City Council shall meet on October 28, 2008 at 7 p.m. in the Council Chambers pursuant to RCW 84.55.120 and hold a public hearing on revenue sources for the city's 2009 current expense budget and on the estimated amount of property taxes to be received from assessed valuations on property within the City of Moses Lake. "Current expense budget" means that budget which is primarily funded by taxes and charges and reflects the provision of on-going services. "Current expense budget" does not mean the capital, enterprise, or special assessment budgets of the city. The hearing shall include consideration of possible increases in property tax revenues. The proposed 2008 property tax levy for collection in 2009 is $5,000,000, which is the amount levied in 2007 for collection in 2008, plus an increase of 1.00% on the maximum tax rate allowed by law which is an estimated increase of $31,974.28 plus an increase equal to the amount allowed under new construction provisions of RCW 84.55.010, any increase due to the annexation of new territory and any increase in the value of state-assessed utility property. After the October 28, 2008 public hearing in the City Council shall consider the first reading of an ordinance setting the 2009 property tax levy. The City Council shall then meet on November 11, 2008 at 7 p.m. in the Council Chambers and consider the second reading of an ordinance setting the 2009 property tax levy.
