You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to wit, within sixty days after May 23, 2008, and defend the above entitled action in the above entitled court, and answer the Complaint for Judicial Foreclosure of the Plaintiff, State of Washington, Department of Social and Health Services (Department), and serve a copy of your answer upon the undersigned attorneys for plaintiff, ROBERT M. MCKENNA, Attorney General, and SCOTT T. MIDDLETON, Assistant Attorney General, at their office below stated; and in case of your failure so to do, judgment will be rendered against you according to the demand of the complaint, which has been filed with the clerk of said court. Pursuant to RCW 43.20B.080, the Department seeks a decree of judgment and foreclosure against the defendants identified in the Complaint for Judicial Foreclosure for recovery of medical assistance provided, title search fees, attorney fees, and such other relief as the court deems just and equitable.

NOTICE OF APPLICATION TO APPROPRIATE PUBLIC WATERS

TAKE NOTICE:

On May 22, 2008, Ecology received from the U.S. Bureau of Reclamation (Reclamation) of Boise, ID, Application No. S3-30556 for a secondary use permit to appropriate public waters based on a 1938 reservation of water, subject to existing rights, from water stored in Franklin D. Roosevelt Reservoir (Columbia River) tributary to the Pacific Ocean, in the amount of 225 cubic feet per second, 37,500 acre-feet each year, for instream flows in the Columbia River in Franklin D. Roosevelt Reservoir and below Grand Coulee Dam. On May 30, 2008, Ecology received from Reclamation an amendment to this application to increase the instantaneous quantity to 305 cubic feet per second. All 37,500 acre-feet of this water will be put to use for instream flow purposes and subsequently transferred to the state trust water program as an instream flow trust water right. 25,000 acre-feet of the trusted water will serve as replacement for new state water rights to be issued by the Department of Ecology for municipal and industrial uses, and 12,500 acre-feet will remain in the Columbia River to benefit instream flows.

This water will be diverted from Franklin D. Roosevelt Reservoir, by and/or through Grand Coulee dam, to the Columbia River downstream of the dam. The point of diversion is located within Government Lots 3 and 4 of Section 1, Township 28 N., Range 30 E.W.M., in Grant County, Washington. A limited quantity of this water may be diverted directly from the reservoir for municipal and industrial uses upstream of Grand Coulee Dam, but only after it has been released by and/or through the dam for instream flow purposes and conveyed to the state trust water program.

Protests or objections to approval of this application must include a detailed statement of the basis for objections; protests must be accompanied by a fifty-dollar ($50.00) recording fee and filed with the Department of Ecology, at the address shown below, within thirty (30) days from June 27, 2008.

On August 19, 2005, Ecology received from the U.S. Bureau of Reclamation (Reclamation) of Boise, ID, Application No. S3-30486 for a secondary use permit to appropriate public waters based on a 1938 reservation of water, subject to existing rights, from water stored in Franklin D. Roosevelt Reservoir (Columbia River) tributary to the Pacific Ocean, in the amount of 200 cubic feet per second, 30,000 acre-feet per year, for the seasonal irrigation of 10,000 acres of land within the Odessa Groundwater Management Subarea and the Columbia Basin Project. On May 22 and May 30, 2008, Ecology received from Reclamation amendments to this application, to increase the instantaneous and annual quantities to 303 cubic feet per second, 45,000 acre-feet per year. Of those amounts, 181 cubic feet per second, 30,000 acre-feet per year, will be used for the seasonal irrigation of 10,000 acres of land within the Odessa Subarea and the Columbia Basin Project, and 122 cubic feet per second, 15,000 acre-feet per year, will be used for instream flow purposes, then conveyed to the state trust water program and remain in the Columbia River to benefit instream flows .

There will be two points of diversion from Franklin D. Roosevelt Reservoir at Grand Coulee Dam, both located within Government Lots 3 and 4 of Section 1, Township 28 N., Range 30 E.W.M., in Grant County, Washington. The Odessa Subarea irrigation water will be diverted from the reservoir to Banks Lake, and the instream flow water will be diverted from the reservoir by and/or through Grand Coulee Dam.

Box 37, 35 C Street NW-Room 207, Ephrata, WA 98823, until 1:30 P.M., Tuesday, July 15, 2008 and will then and there be opened and publicly read for the construction of the improvements.

All bid proposals shall be accompanied by a bid proposal deposit in cash, certified check, cashier's check, or surety bond in an amount equal to five percent (5%) of the amount of such bid proposal. No conditional bid bond will be accepted. This contract provides for the reconstruction of an existing bridge on a two lane county road in Grant County, WA, and includes removal of the existing bridge, roadway excavation, embankment compaction, crushed surfacing base course, maintenance rock, hot mix asphalt, concrete class 4000 for abutment footings and walls, superstructure for Bridge #118, beam guardrail, and other work in accordance with the plans and specifications.

This contract provides for the reconstruction of 2.47 miles on 10-SW & 0.73 miles on V-NW, two lane county roads in Grant County, WA, and includes subgrade preparation, crushed surfacing base course, crushed surfacing top course, maintenance rock, beam guardrail type 1, beam guardrail non-flared terminal, and other work in accordance with the plans and specifications.
