Microsoft - Columbia Data Center has applied for a modification of their state waste discharge permit in accordance with the provisions of Chapter 90.48 Revised Code of Washington (RCW), Chapter 173-220 Washington Administrative Code (WAC), and the Federal Clean Water Act.

The modification is for additions to the industrial wastewater facility to control wastewater flow rates to below what is currently permitted. Additional facilities include a discharge storage lagoon, an evaporation lagoon to collect wastewater from a new water demineralization plant, and wastewater collection and conveyance systems including three industrial wastewater liftstations.

The wastewater, following treatment, must meet the requirements of the Washington State Water Pollution Control Act and applicable regulations for a permit to be issued.

The Department of Ecology is proposing to modify the permit and is hereby issuing public notice of its intent. Interested persons are invited to submit their name, address, and comments regarding this permit to:

Notice of Application and Proposed Mitigated Determination of Non-Significance

Date of Notice: June 16, 2008

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA Checklist received by Grant County on April 2, 2008 from Pelican Point Homeowners Association (Designated Contact: John Hermann, CBMI, 3740 Thayer Rd. NE, Moses Lake, WA 98837, 509-989-4318), were found to be technically complete on April 30, 2008. Grant County expects to issue a Mitigated Determination of Nonsignificance for this proposal, and the Optional DNS Process in WAC 197-11-355 is being used. This proposal may include mitigation measures under applicable codes, and the project review process may incorporate or require mitigation measures regardless of whether an EIS is prepared. This may be the only opportunity to comment on the environmental impacts of the proposal and the proposed mitigation measures. A copy of the subsequent threshold determination may be obtained upon request. PROPOSED MITIGATION MEASURES: 1. The landowner/applicant is responsible to determine if other permits and/or licenses will be required by other local, state, and Federal agencies for this proposal. The landowner/applicant shall acquire all such permits and/or licenses as required. 2. This proposal shall comply with any/all applicable Federal, state, and local regulations in place at the time the JARPA and SEPA applications were deemed Technically Complete; that date being April 30, 2008 in this instance. 3. This proposal shall be subject to any/all conditions as deemed necessary by applicable agencies of jurisdiction, including, but not limited to: (a) WA State Dept. of Ecology, (b) WA Dept. of Fish & Wildlife, (c) WA State Dept. of Natural Resources, (d) U.S. Army Corps of Engineers. 4. If any Native American grave site(s) or archaeological/cultural resources (Indian artifacts) are found, all construction activity shall stop and the owner/developer shall immediately notify the Grant County Planning Dept., Colville Confederated Tribes, and the WA State Office of Archaeology & Historic Preservation. 5. The landowner/applicant shall take all measures as necessary to minimize and control sediment run-off into Moses Lake during construction and completion of this project, including, but not limited to: (a) Use of silt fences in conjunction with bales of hay to prevent and/or lessen soil erosion, (b) Replant disturbed soils with native vegetation following construction, (c) Consult with the WA Dept. of Fish & Wildlife (Ephrata Office) in order to determine the best methods and/or processes of erosion control, (d) Any excavated material(s) must be deposited landward of the shoreline and/or removed from the subject parcel, thereby lessening sedimentation and erosion, (e) Any rocks moved during construction for the placement of support legs for the dock must be deposited underneath the dock thereby enhancing habitat for native wildlife. 6. The landowner/applicant shall alter the shoreline only to the minimum extent necessary so as to complete the proposed project. 7. The amount of shoreline and/or wetland vegetation disturbed by construction activities shall be kept to the minimum extent necessary in order to complete the project. Upon completion of the project, any/all disturbed areas shall be replanted with native wetland, aquatic, and/or terrestrial species as approved by the WA Dept. of Fish & Wildlife. 8. Construction of the 12-ft. wide x 30-ft. long poured-in-place concrete boat launch shall be done during the annual draw-down (when the water level is low enough to allow work with minimal disturbance of lands below the Ordinary High Water Mark). 9. The widening of the existing gravel turn-around/maneuvering area as proposed by this project shall not occur closer than 20 ft. to any existing shoreline. PROJECT: Construction of two (2) 60-ft. long docks, each one of which will consist of a 6-ft. wide x 20-ft. long freestanding walkway connecting to a 10-ft. wide x 40-ft. long freestanding dock; construction of a 12-ft. wide x 30-ft. long poured-in-place concrete boat launch to be located between the two docks; widening of the existing gravel turn-around/maneuvering area; posting of signs to prohibit parking in the immediate vicinity of the docks and boat launch.
