The sale will be made without warranty, express or implied regarding title, possession, or encumbrances on February 8, 2008. The default(s) referred to in paragraph III, together with any subsequent payments, late charges, advances costs and fees thereafter due, must be cured by 01/28/08 (11 days before the sale date), to cause a discontinuance of the sale. The Washington State Department of Ecology invites you to comment on the proposed removal of the Grant County PUD Diesel Generating Facility site from the Hazardous Sites List. The site is located at 9422 Tyndall Road NE in the city of Moses Lake, Grant County, Washington.

The Hazardous Sites List is a list of contaminated sites throughout the state that are ranked on a scale of one to five. One represents the greatest potential threat to human health and the environment; five the least potential threat. The site ranked a five.

The Grant County PUD was preparing generators for an air quality test in May 2004. As part of the preparation, fuel was sent into pipes that supplied the generators. During the fueling, pipes located in an underground concrete vault leaked. Within an hour of beginning the fueling process, a spill was noticed and the system was shut down. It appeared the leak occurred where the pipeline first went underground between the two banks of generators on the northeast side of the facility.

Contractors removed more than 1,200 yards of diesel-contaminated soil from the site after the spill in May 2004. Concrete pads that two generators sat on also were removed. As a result of the cleanup, the site is now considered ready for removal from Ecology's Hazardous Sites List. Groundwater was not impacted by the spill.

Ecology proposes removing the Grant County PUD Diesel Generating Facility from the Hazardous Site List based upon the following:

  • Review of independent cleanup reports submit- ted to Ecology.
  • Supporting documentation.
  • Work completed at the site meets state cleanup requirements.

Legal Notice

The Grant County Board of Health will hold a public hearing in the City of Ephrata meeting room at 121 Alder St. SW in Ephrata on Wednesday, February 13, 2008 at 7:00 p.m. The purpose of the hearing will be to adopt Ordinance 2008-1, amendment to the food ordinance. Anyone wishing to comment regarding this matter should appear at the meeting.

McDonald's: Steve Marsh, TD & H, submitted an application for site plan review on January 11, 2008. The application was determined to be complete and ready for review on January 23, 2008. The proposal is to raze the existing McDonald's restaurant and build a 4, 090 square foot modern facility, in the C-2, General Commercial & Business Zone. The site is located at 825 North Stratford Road, legally describes as Lot 1, Columbia Basin Center. The project has been determined to be consistent with the City's Comprehensive Plan, and the following development regulations are applicable: Moses Lake Municipal Code (MLMC) Title 16: Building and Construction, Title 18: Zoning, Title 20: Development Review Process.

The Planning Commission will conduct a public hearing on February 28, 2008 at 7:00 p.m. in the City Council Chambers located at 401 Balsam Street. All interested persons are encouraged to attend and provide comment.

Written comments on this proposal will be accepted until 5:00 p.m. on the date of the public hearing. Persons who want to be informed of future actions, or the final decision, on this proposal should provide their name and address to the project planner. The final decision on this proposal will be made within 120 days of the date of the notice of completeness and may be appealed according to the City appeal provisions specified in MLMC 20.11, Appeals.
