AMENDED NOTICE OF APPLICATION FOR CHANGE/TRANSFER OF WATER RIGHT UNDER ONE (1) GROUND WATER PERMIT

TAKE NOTICE:

That the Port of Mattawa, Washington has made application for change/transfer of water right in order to add two-(2) Points of Withdraw (POW) as granted under Ground Water Permit No.

G3-29072P.

That said permit authorizes the withdrawal of 2,250 gallons per minute, 1,200 acre-feet per year, continuously, for commercial and industrial supply and as needed for fire protection.

That the authorized POW are from two-(2) wells located as follows: 1) SW1/4SE1/4SE1/4 of Sec. 34 and 2) SW1/4NE1/4NW1/4 of Sec. 27; BOTH WITHIN T. 15 N., R. 23 E.W.M.

That they propose to add two-(2) additional POW to be located as follows: 3) and 4) BOTH WITHIN W1/2W1/2SW1/4 of Sec. 27, T. 15 N, R. 23 E.W.M.

All within Grant County, Washington.

NOTICE OF APPLICATION and SEPA MDNS

Notice is hereby given that a JARPA (Shoreline Substantial Development & Conditional Use Permit) and SEPA checklist received on January 2, 2008 from Tom Merrill (Designated Contact: John Hermann, CBMI, 3740 Thayer Rd. NE, Moses Lake, WA 98837, 509-989-4318), were found technically complete and preliminarily appear to be consistent with Unified Development Code and other applicable state and local requirements as of March 17, 2008. PROJECT: Construction of a 10-ft. wide x 20-ft. long freestanding dock, a 6-ft. wide x 10-ft. long wheelchair ramp, a 10-ft. x 10-ft. x 10-ft. tall roofed gazebo, installation of a freestanding 9-ft. x 10-ft. boatlift, and an 8-ft. wide by approximately 300-ft. long access path (with two switchbacks) through the shoreline environment. Future developments include a 24-ft. x 66-ft. addition to an existing deck, a retaining wall, a pool, and a Jacuzzi. SEPA: MDNS issued March 20, 2008. LOCATION: Site address of the subject parcel is 5040 Shorecrest Drive NE, Moses Lake, WA, located in the SW and SE quarters of S. 5, T. 19N, R. 28E, WM, Grant County, WA (Parcel #31-1688-000). TAKE NOTICE:

Mr. Gerald Brown of Royal City has made an APPLICATION FOR CHANGE/TRANSFER of Water Right to change the place of use of Groundwater Permit G3-29201 to the Board. The board has designated such application for active Board review and has assigned number GRAN-08-01 to this application. The Department of Ecology has assigned their tracking number CG3-29201@5

That Ground Water Permit G3-29201P with a priority date of May 26, 1992 has current authorization for 6300 gallons per minute, 2880 acre-feet per year, for seasonal irrigation of 960 acres within: All of Section 12; the N1/2 of Section 13, lying northerly of the W61C Canal; Both in T17N, R23E, W.M.; AND the SW1/2 of the SW1/4 of Section 6, T17N, R24E, W.M.; AND 120 acres within a 1290 foot circle radius within the NE1/4 of section 9, T17N, R23E; AND that portion of the NW1/4 of Section 10, T17N, R23E that lies west of the Bonneville Power Lines. The authorized points of withdrawal are 6 wells defined and located: Well 1 [DOE#AFL-143] SE1/4NW1/4 Sec 27, Well 2 [DOE #AFL-144] NW1/4SW1/4 Sec 27, Well 6 [DOE#AFL145] NW1/4SW1/4 Sec 27, Well 7 [DOE#AFL-146] NW1/4NE1/4 Sec 27, Well 8 [DOE#AFL-147] NW1/4NW1/4 Sec 27; And an authorized well within NW1/4NE1/4 of section 15; all sections listed within T17N, R23E, W.M., Grant County.

The proposed new place of use is 960 acres within: Two 1330 foot radius circles in the N1/2 of Section 12, totaling 255.14 acres; plus Two 1300 foot radius circles in the S1/2 of Section 12, totaling 243.76 acres; plus One 1301 foot radius circle covering 250 degree arc in the NW1/4 of Section 13, lying north of the W61C canal. Totaling 84.65 acres; plus The NE1/4 of the NE1/4 and E1/2 of NW1/4 of the NE1/4 of Section 13 lying north of the W61C canal. Totaling 46.45 acres; plus SW1/4 of the SW1/4 Section 6, T17N, R24E, W.M., totaling 40 acres; plus One 1290 foot radius circle within the NE1/4 Section 9, and a portion of the NW1/4 Section 10 lying west of the Bonneville Power Lines, totaling 120 acres; plus One 1171 foot radius full circle, and one 1290 foot radius circle ope rating in an 213 degree arc both in Section 9 lying westerly of the Bonneville Power Lines, Totaling 170 Acres. All sections, except Section 6, listed above are within T17N, R23E. W.M., Grant County. There is no change to the authorized amount of water, its purpose of use, or points of withdrawal.

Any interested party may submit comments, objections, and other information to the board regarding this application. The comments and information may be submitted in writing or verbally at any public meeting of the board held to discuss or decide on the application. Additionally, the Water Conservancy Board will consider written comments or information provided within thirty (30) days from the last date of publication of this notice, said written comments or information to be provided to its office located at 3953 Airway Drive, Moses Lake, WA 98837.

Any protests or objections to the approval of this application may be filed with the Department of Ecology and must include a detailed statement of the basis for objections.
