ADDITION OF LAND TO

MOSES LAKE IRRIGATION AND

REHABILITATION DISTRICT

PURSUANT TO RCW 87.03.55

The Petitioner(s) Schiffner 320 LLC, Margaret L. Schiffner, Mgr. filed a Petition for Addition of Land to Moses Lake Irrigation and Rehabilitation District pursuant to RCW 87.03.560, dated July 27, 2007.

The Petitioners seek to add certain property owned by the Petitioner to the existing boundary for the Moses Lake Irrigation and Rehabilitation District ("District"). Petitioner's property to be included in the District boundary is described as follows.

Parcel #161353000; Gov. Lots 1-4, inclusive, SW1/4 of NW1/4, SE1/4 of NW1/4 AND SW1/4 of NE1/4, all Section 1, Township 19 North, Range 27 E.W.M., Grant County Washington.

All persons interested in matters related to the Petition, or that may be affected by such change of the boundaries of the district, shall appear at the offices of the Moses lake Irrigation and Rehabilitation District, 932 E. Wheeler Road, Moses Lake, Washington, at 7:00 p.m. on the 9th day of October, 2007, and show cause in writing why the change in the boundaries of the Moses Lake Irrigation and Rehabilitation District, to include the above described property, as stated in the Petition, should not be made.

Failure to attend the above described hearing and show cause, in writing, any objections to the additions of said property shall be deemed an assent to the proposed addition.

TAKE NOTICE:

That Skone & Connors Produce, Inc. of Warden, Washington has made application for change/transfer of water right in order to change the points of withdrawal (POW) & change/transfer a portion of the place of use (POU) as granted under Ground Water Permit No. G3-29162P.

That said permit authorizes the withdrawal of 3,000 gallons per minute, 1,120 acre-feet per year for the seasonal irrigation of 320 acres.

That the authorized points of withdrawal are from six-(6) wells located as follows: 1) S1/2NW1/4 of Sec. 24; 2) NW1/4NW1/4NE1/4 of Sec. 24; 3) NE1/4NE1/4 of Sec. 24; 4) N1/2NW1/4SE1/4 of Sec. 23; 5) E1/2SE1/4N1/4 of Sec. 25 and 6) SW1/4SW1/4NW1/4 of Sec. 24; ALL WITHIN T. 17 N., R. 27 E.W.M.

That the authorized place of use is located within the S1/2 of Sec. 23, T. 17 N., R. 27 E.W.M.

That they propose to correct well No.'s 5 & 6 to be located as follows: 5) SW1/4NE1/4 of Sec. 25 and 6) NW1/4NW1/4 of Sec. 24; BOTH WITHIN T. 17 N., R. 27 E.W.M.

That they propose to change a portion of the place of use to be located as follows: 244 acres within the S1/2 of Sec. 23 and 76 acres within the SE1/4 of Sec. 24; ALL WITHIN T. 17 N., R. 27 E.W.M.

All within Grant County, Washington.

Protests or objections to approval of this application must include a detailed statement of the basis for objections; protests must be accompanied by a fifty-($50.00) dollar recording fee and filed with the Department of Ecology, at the address shown below, within thirty (30) days from September 17, 2007.

LAKEFRONT PROPERTY FOR SALE

The Board of Directors of the Moses Lake Irrigation and Rehabilitation District determined at its public meeting held August 14, 2007 that two parcels of property owned by the District in Moses Lake with tax parcel identification numbers of 111190000 (1340 Marina Drive) and 111191000 (1334 Marina Drive) should be sold. The Directors have determined it is in the best interest of the District to sell the Lots as they are no longer necessary or needed for use by the District.

The District's General Manager is authorized and directed to advertise the Lots for sale at $300,000 for both lots through a sealed bid process. Information packets on the Parcels may be obtained at the District office. All bids should be placed in an envelope marked "Sealed Bid", placed in an outside envelope and delivered to the District office at 932 E. Wheeler Road, Moses Lake WA by the close of business on September 20, 2007. All bids will be opened at 12:00 p.m. (noon) September 24, 2007. The District reserves the right to extend the time for receiving and opening bids, reject any nonconforming bids, or reject bids failing to meet a minimum bid price.

NOTICE OF MITIGATED

DETERMINATION OF

NON-SIGNIFICANCE

NOTICE IS HEREBY GIVEN that the City of Moses Lake issued a Mitigated Determination of Non-Significance (MDNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Walker Hills Major Plat - Subdivide 4.8 acres into 12 multi-family lots. The proponent is ABK LLC, Columbia, MO. The site is legally described as NWNW S26-T19N-R28E, and is located east of Division Street and south of Nelson Road, in the R-3 Multi-family zone.

After review of the completed environmental checklist and other information on file with the City of Moses Lake, the SEPA Responsible Official has determined this proposal will not have a probable adverse impact on the environment if the stipulated mitigation is provided. Pursuant to WAC 197-11-340(2) the lead agency will not act on this proposal for 14 days from the date of determination. Comments on the MDNS must be submitted by September 26, 2007 to the Responsible Official.
