REC Silicon Inc. has applied for a modification of their National Pollutant Discharge Elimination System (NPDES) permit in accordance with the provisions of Chapter 90.48 Revised Code of Washington (RCW), Chapters 173-220 and 173-216 Washington Administrative Code (WAC), and the Federal Clean Water Act.

REC Silicon Inc. presently operates a high purity polysilicon production plant in Moses Lake. Wastewater from the operations is discharged to the City of Moses Lake, Sand Dunes Treatment Plant (low chloride process wastewater); and to irrigation return drain DE-226 (cooling tower blowdown). The modified permit covers the proposed increase in the low chloride wastewater discharged to the City of Moses Lake, Sand Dunes Treatment Plant due to a plant expansion. The discharge to the irrigation return drain will not be affected by the expansion. The wastewater, following treatment, must meet the requirements of the Washington State Water Pollution Control Act and applicable regulations for a permit to be issued.

Following evaluation of the application and other available information, a modified permit has been developed which would allow an increase in discharge to the City of Moses Lake, Sand Dunes Treatment Plant (Outfall 003) from 110,000 to 144,000 gallons per day, monthly average; and from 132,000 to 300,000 gallons per day, daily maximum. There will be no other changes to the existing permit. The Department will only consider comments on the modified portions of this permit.

A tentative determination has been made on above modifications that will continue to prevent and control pollution. A final determination will not be made until all timely comments received in response to this notice have been evaluated.

PUBLIC COMMENT AND INFORMATION

The modified permit and the amended and original fact sheet may be viewed at the Department of Ecology (Department) website: http://www.ecy.wa.gov/programs/wq/permits/eastern_permits.html. The application, fact sheets, proposed modified permit, and other related documents are also available at the Department's Eastern Regional Office for inspection and copying between the hours of 8:00 a.m. and 5:00 p.m., weekdays.
