SUMMARY
This ordinance creates a new section of the Othello Municipal Code providing for uses that are prohibited in all zones, unless specifically allowed by code, including: portable toilets; electric fences; boats, water crafts, vehicles or trailers that are used for habitation purposes; and signs, except as permitted by city or state regulations.

NOTICE OF APPLICATION TO CONSTRUCT A NEW AIR POLLUTION SOURCE
& DRAFT SECOND TIER ANALYSIS APPROVAL
This public notice replaces the notice that was published on October 1, 2007. The 30 day comment period begins on the date that this notice is published.
The State of Washington Department of Ecology (Ecology) has received application to construct a new air pollution source. Yahoo! Inc. has proposed installation of a Data Center located at 1115 Industrial Loop Road, Quincy in Grant County. The primary air pollution emission units at the Data Center will be 13 diesel engines used to power electric generators rated at a total of 29.64 megawatts of emergency backup power. Toxic air pollutant emissions from diesel engines required a Second Tier Analysis to evaluate ambient air impacts. After review of the completed Notice of Construction application and other information on file with the agency, Ecology has made a Preliminary Determination that this proposal will conform to all requirements as specified in Chapter 173-400 WAC and Chapter 173-460 WAC. After review of the Second Tier Analysis, Ecology concluded that the health risks to the community were acceptable. Copies of the preliminary determination and other supporting information are available for public review at Department of Ecology, Eastern Regional Office, 4601 N. Monroe, Spokane, WA 99205-1295, and at the City of Quincy, 104 B Street SW, Quincy, WA 99357. The public is invited to comment on the project proposal by submitting written comments postmarked within 30 days of this notice to Gregory Flibbert at the above Spokane address. A public hearing may be held if significant public interest exists.

H & H Steel Buildings LLC, on behalf of owners Carlos and Norma Diaz, applied for a Site Plan Review on October 2, 2007. The application was determined to be complete and ready for review on October 9, 2007. The proposal is to construct a 2,816 square foot building for an auto detail business, in the (C-2) General Commercial zone. The site is located at 1031 W. Marina Drive; on property described as Lot 11, Block 1, Parkhill-Scea Addition. The project has been determined to be consistent with the City's Comprehensive Plan and the following Development Regulations are applicable to the project: Moses Lake Municipal Code 18.35.

CURRENT EXPENSE BUDGET
SETTING PROPERTY TAX LEVY
The City Council shall meet on October 23, 2007 at 7 p.m. in the Council Chambers pursuant to RCW 84.55.120 and hold a public hearing on revenue sources for the city's 2008 current expense budget and on the estimated amount of property taxes to be received from assessed valuations on property within the City of Moses Lake. "Current expense budget" means that budget which is primarily funded by taxes and charges and reflects the provision of on-going services. "Current expense budget" does not mean the capital, enterprise, or special assessment budgets of the city. The hearing shall include consideration of possible increase in property tax revenues. The proposed 2007 property tax levy for collection in 2008 is $2,980,705, which is the amount levied in 2006 for collection in 2007, plus an increase of 1.00% on the maximum tax rate allowed by law which is an estimated increase of $29,512 plus an increase equal to the amount allowed under the new construction provisions of RCW 84.55.010, any increase due to the annexation of new territory and any increase in the value of state-assessed utility property. After the October 23, 2007 public hearing the City Council shall consider the first reading of an ordinance setting the 2008 property tax levy. the City Council shall then meet on November 13, 2007 at 7 p.m. in the Council Chambers and consider the second reading of an ordinance setting the 2008 property tax levy.

PUBLIC HEARING NOTICE
The Preliminary Budget for the 2008 fiscal year has been filed with the Finance Director. Copies of the preliminary budget may be examined and/or obtained at the Office of the Finance Director during normal business hours.
