REC Silicon Inc. has applied for a modification of their National Pollutant Discharge Elimination System (NPDES) permit in accordance with the provisions of Chapter 90.48 Revised Code of Washington (RCW), Chapters 173-220 and 173-216 Washington Administrative Code (WAC), and the Federal Clean Water Act.

REC Silicon Inc. presently operates a high purity polysilicon production plant in Moses Lake. Wastewater from the operations is discharged to the City of Moses Lake, Sand Dunes Treatment Plant (low chloride process wastewater); and to irrigation return drain DE-226 (cooling tower blowdown). The modified application covers the proposed increase in the low chloride wastewater discharged to the City of Moses Lake, Sand Dunes Treatment Plant due to a plant expansion. The discharge to the irrigation return drain will not be affected by the expansion. The wastewater, following treatment, must meet the requirements of the Washington State Water Pollution Control Act and applicable regulations for a permit to be issued.

The Department of Ecology is proposing to renew the permit and is hereby issuing public notice of its intent. Interested persons are invited to submit their name, address, and comments regarding this permit to:

NOTICE OF PROPOSED MODIFICATION OF INDUSTRIAL WASTEWATER

DISCHARGE PERMIT

On or about June 22, 2006, the Department of Ecology reissued State Waste Discharge Permit No. ST 8085 to Weyerhaeuser Company. On or about July 25, 2006, Weyerhaeuser appealed the Permit to the Pollution Control Hearings Board.

A settlement was reached between the two parties. Based on the settlement, Ecology will initiate the following modifications to the Permit:

a) At Condition S1 of the Permit, replace the 300 mg/l maximum daily BOD effluent limitation with a 95 lbs/day maximum daily BOD effluent limitation.

b) At Condition S1 of the Permit, replace the 350 mg/l maximum daily TSS effluent limitation with a 111 lbs/day maximum daily TSS effluent limitation.

PUBLIC COMMENT AND INFORMATION

Any interested party is invited to submit written comments on the proposed modification. Comments must be submitted within thirty (30) days after publication of this notice to be considered for the Final Determination. Comments should be sent to:

Ochoa Foods has applied for a renewal of its State Waste Discharge permit in accordance with the provisions of Chapter 90.48 Revised Code of Washington (RCW) and Chapter 173-216 Washington Administrative Code (WAC).

Ochoa presently owns or operates a potato processing facility that discharges its process wastewater to the City of Warden's industrial wastewater treatment facility. The average daily flow of process wastewater from Ochoa is 494,000 gallons per day. The city's treatment facility is designed for 1.6 million gallons per day. The wastewater, following treatment, must meet the requirements of the Washington State Water Pollution Control Act and applicable regulations for a permit to be issued.

Following the evaluation of the application and other available information, a draft permit has been developed which would continue to allow the discharge of treated industrial wastewater from Ochoa to the City of Warden.

A tentative determination has been made on the effluent limitations and special permit conditions that will prevent and control pollution. A final determination will not be made until all timely comments received in response to this notice have been evaluated.
