NOTICE: Quincy Ground Water Subarea Licensees

As a reminder, landholders who either directly or indirectly own and/or lease land in the Subarea over the forms submittal threshold must file annual Reclamation Reform Act of 1982 (RRA) forms by March 1, 2007 to be eligible to receive Reclamation irrigation water. This includes but is not limited to individuals, entities, trusts, estates, public entities, religious or charitable organizations, and farm operators. This is a westwide disclosure. Any and all land must be counted if it is in a district subject to the RRA.

Please contact the RRA staff in Boise, Idaho, toll free at 888-767-3850 if you have any questions about your submittal threshold or entitlements, what forms are required, or for any questions you may have about the forms.

RRA forms are to be submitted to the Bureau of Reclamation, Attn: PN-3328, 1150 N. Curtis Road, Suite 100, Boise, ID 83706-1234.

Reclamation's Boise RRA staff will be in the Ephrata Field Office on February 14, 2007 to collect 2007 RRA forms and answer basic questions. Separate notification regarding details will be sent to Subarea licensees that are required to file forms.

NOTICE

Notice is hereby given that sealed bids will be received by Port of Ephrata at its office at 1990 Division Avenue E., Ephrata, WA 98823, until 1 p.m., March 8, 2007, for Taxiway A Relocation and Runway 3-21 Establishment Project, at which time the bids will be opened publicly and read aloud. Any bids received after the time for opening will not be considered.

The work to be completed includes constructing a new Taxiway "A", 35 feet wide and 5,500 feet in length, and marking the new Runway 3-21 on the existing apron. Major work elements include excavation, grading, base rock placement, asphalt paving, underdrain/drainage installation, pavement marking, signage installation, and taxiway edge reflector installation.

Drawings, technical provisions, and forms of contract documents may be examined at Ephrata Municipal Airport, 1990 Division Avenue E, Ephrata, WA 98823, or in the office of Reid Middleton, Inc., Consulting Engineers, 728 134th Street SW, Suite 200, Everett, Washington, 98204. Sets of said documents may only be obtained from Port of Ephrata by qualified bidders upon payment of a non-refundable fee of $50 for each set. Contact the Port of Ephrata at (509) 754-3508.

Each bid shall be accompanied by a cashier's check, certified check, postal money order, or bid bond made payable to Port of Ephrata in an amount not less than five percent (5%) of the amount of the bid. Said check or bid bond shall be given as a guarantee that the bidder shall execute such contract as may be awarded to him/her in conformity with his/her bid and with the contract documents and shall provide surety bond or bonds as specified therein within ten days after notification of the award of contract.

Bidders are advised that a mandatory pre-bid meeting for all prime contractors is scheduled for 10 a.m. on February 22, 2007, at the Airport Terminal Building 1990 Division Avenue E, Ephrata, WA 98823. This shall be a condition of being a qualified bidder, among other conditions set forth in the contract documents. Those submitting bids that do not attend will not be considered.

All bidders and primary subcontractors are strongly urged to examine the site to become familiar with all site conditions prior to the bid.

1. The proposed contract is under and subject to Executive Order 11246 of September 24, 1986, and to the Equal Employment Opportunity (EEO) and Federal Labor Provisions.

2. All labor on the project shall be paid no less than the minimum wage rates established by the U.S. Secretary of Labor. The Contractor shall pay the rate that is highest of the Washington State or Federal Wage Rates.

3. Bidders shall supply all information required by the bid documents and specifications.

4. The EEO requirements, labor provisions and wage rates are included in the specifications and bid documents and are available for inspection at the Airport.

5. Bidders shall complete, sign, and furnish with their bids a "Certification of Nonsegregated Facilities" and a statement entitled "Bidders Statement on Previous Contracts Subject to EEO Clause," as contained in the bid proposal.

6. A contractor or subcontractor who may be awarded a contract of $10,000 or more will be required to maintain an affirmative action program, the standards for which are contained in the FAA Special Provisions.

7. Where the low bid is in the amount of $1 million or more, the bidder and bidder's known first-tier subcontractors that will be awarded subcontracts of $1 million or more will be subject to preaward compliance reviews for the purpose of determining whether the bidder and bidder's subcontractors are able to comply with the provisions of the equal opportunity clause.

8. To be eligible for award each bidder shall comply with the affirmative action requirements contained in the FAA Special Provisions.

9. Disadvantaged business enterprises shall comply with the affirmative action requirements contained in the FAA Special Provision.

10.This contract will be funded in part by a grant from the FAA. In accordance with Federal requirements, the Port of Ephrata has determined that this contract has subcontracting possibilities and encourages the use of firms owned and controlled by Disadvantaged Business Enterprise (DBE). All bidders are directed to the FAA Special Provisions with regard to the procedures the Port of Ephrata will utilize to encourage DBE participation. Bidders shall furnish the "DBE Utilization" form and "Letter of Intent" and/or "Good Faith Effort" documentation as contained in the bid proposal with their bids.

The DBE goal for this project is 7.1% of the total amount bid. Based on the 9th Circuit Court Decision in Western States Paving Company v. Washington State Department of Transportation, the Port of Ephrata has determined that it is appropriate to use a race/gender neutral goal. The Port of Ephrata encourages all bidders to take active race/gender neutral steps to include DBEs in this and other airport contracts. Race/gender neutral steps include: unbundling large contracts, subcontract work the prime contractor may self- perform, provide bonding or financing assistance, provide technical assistance, etc. This contract can be awarded without the lowest responsive bidder meeting the goal or demonstrating good faith effort to meet the goal.

11. Women will be afforded equal opportunity in all areas of employment. However, the employment of women shall not diminish the standards or requirements for the employment of minorities.

The Owner reserves the right to reject any and/or all bids and to waive irregularities or informalities in the bid or in the opening.

Bidders shall not withdraw bids after the hour set for the opening thereof, or before award of contract, unless said award is delayed for a period exceeding seventy (90) days.

The award of the contract is subject to approval of the Federal Aviation Administration and the availability of federal funding.

MITIGATED DETERMINATION OF NONSIGNIFICANCE

PUBLIC NOTICE

The Washington State Department of Ecology and the City of Moses Lake has issued a Mitigated Determination of Non-significance (MDNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project and location: Construction and operation of a corn based 100 million gallon per year ethanol production facility with associated activities. The ethanol production facility will be located at 13583 Wheeler Road NE, Moses Lake, within the NE1/4 of Section 20, Township 19 North, Range 29 East Willamette Meridian, in Grant County. The project proposal was submitted by Washington Ethanol LLC, 530 Quintanilla Drive, Moses Lake, WA 98837. After review of the completed Environmental Checklist and other information on file with the agency, Ecology and the City of Moses Lake have made a preliminary determination that the proposal will not have a probable significant adverse impact on the environment. Copies of the Environmental Checklist and the Mitigated Determination of Non-significance are available at no charge from the Washington State Department of Ecology, Air Quality Program, 4601 N.
