5. Delinquencies Under Contracts and Amounts Required to Cure. As
of the date hereof the defaults under the Contract and amounts

6. The Contract will be forfeited if all defaults are not cured on

7. The effects of forfeiture shall be:
(i) Termination of all right, title and interest in the
property of the Purchaser and all persons claiming
through the Purchaser or whose interests are otherwise
subordinate to the sellers interest in the property;
(ii) Cancellation of all of the Purchaser's rights under the
contract;
(iii) Forfeiture to the Seller of all sums previously paid
under the contract;
(iv) Forfeiture to the Seller of all of the improvements to
the Property (by whomever made) and in unharvested crops
and timber;
(v) Purchaser and all other persons occupying the property
whose interest are forfeited shall be required to
surrender possession of the Property, improvements, and
unharvested crops and timber, to the Seller ten days
after a Declaration of Forfeiture is recorded.
8. You may have a right to contest this forfeiture or to seek an extension of time to cure the default if the default does not involve a failure to pay moneys or both, by commencing a court action by filing and servicing the summons and complaint before the Declaration of Forfeiture is recorded.
9. You may have the right to request a court to order a public sale of the property; that such public sale will be ordered only if the court the court finds that the fair market value of the property substantially exceeds the debt owed under the contract and any other liens having priority over the seller's interest in the property; that the excess, if any, of the highest bid at the sale over the debt owed under the contract will be applied to the liens eliminated by the sale and the balance, if any, paid to the purchaser; that the court will require the person who requests the sale to deposit the anticipated sale costs with the clerk of the court; and that any action to obtain an order for public sale must be commenced by filing and serving the summons and complaint before the Declaration of Forfeiture is recorded.
10. The Seller is not required to give any person any other notice of default before the declaration which completes the foreclosure given.

and Public Hearing
Smart Homes submitted an application for a short subdivision with platting waivers and a shoreline substantial development permit on June 19, 2007. Additional required information was submitted on July 3 and Aug. 1. The application was determined to be complete and ready for review on Aug. 8, 2007. The proposal is to subdivide 1.71 acres of land into 4 residential lots in the R-3, Multi-family Zone. The site is located west of the Marina Shores planned development at 1300 Marina Drive, on the east 5 acres of Government Lot 4 in S21-T19N-R28E. The following development regulations are applicable to the project: Moses Lake Municipal Code (MLMC) Title 14: Environmental Regulations, Title 16: Buildings and Construction, Title 17: Subdivisions, Title 18: Zoning, Chapter 19.03: Critical Areas, Chapter 19.06: Wetlands, and Title 20: Development Review Process.
The Planning Commission will conduct a public hearing on Oct. 11, 2007 at 7:00 p.m. in the City Council Chambers located at 401 Balsam Street. All interested persons are encouraged to attend and provide comment.
Written comments on the environmental impacts of this proposal will be accepted until Sept. 10, 2007. Written comments on other aspects of this proposal will be accepted until 5:00 p.m. on the date of the public hearing. Persons who want to be informed of future actions, or the final decision, on this proposal should provide their name and address to the project planner. The final decision on this proposal will be made within 120 days of the date of the notice of completeness and may be appealed according to the City appeal provisions specified in MLMC 20.11, Appeals. DETERMINATION OF
NON-SIGNIFICNCE ISSUED ON OCTOBER 12, 2005 HAS BEEN WITHDRAWN
AND THAT A NEW MITIGATED
DETERMINATION OF
NON-SIGNIFICANCE HAS BEEN ISSUED
NOTICE IS HEREBY GIVEN that the City of Moses Lake has withdrawn the Mitigated Determination of Non-Significance issued on October 12, 2005 and has issued a new Mitigated Determination of Non-Significance (MDNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:
Power Pointe Major Plat I, II, and III - Subdivide 27 acres into 99 single family residential lots in the R-1, Single-Family Residential Zone with associated street and utility construction. Portions of the site abut a Category III Wetland and are within 200' of the ordinary high water mark. None of the proposed lots will front the lake. The proponent is Smart Homes, Inc. and the site is located north of the intersection of Linden Avenue and Beaumont Drive and east of the railroad ROW in S27, T19N, R28E.
Reason for Withdrawal of October 12, 2005 MDNS and Reason to issue a New MDNS: The Power Pointe Major Plats were originally designed to manage storm water by infiltrating through on-site drywells consistent with the City of Moses Lake Storm Water Standards. During the course of construction the site was found to lack sufficient permeability to manage storm water. As a result a new method of storm water management has been proposed. Storm water will be conveyed throught catch basins to an underground piped storm water system and discharged through a category III wetland into Moses Lake. Storm water manhole structures will be constructed with a sump in the bottom to capture silt and sediment. The storm water system will reduce the velocity of storm water discharge to approximately 1.7 cubic feet per second or slower in order to provide the existing wetland vegetation the ability to naturally absorb and infiltrate the storm water flow.
Due to the substantial changes of the storm water control method, it was determined that the proposal would likely result in probable significant adverse environmental impacts in the absence of appropriate mitigation measures, and therefore the October 12, 2005 MDNS is withdrawn pursuant to WAC 197-11-340(3)(a)(i).
After review of the completed environmental checklist, checklist addendum, and other information on file with the City of Moses Lake, the SEPA Responsible Official has determined this proposal will not have a probable adverse impact on the environment if the stipulated mitigation is provided. Pursuant to WAC 197-11-340(2) the lead agency will not act on this proposal for 14 days from the date of determination. Comments on the MDNS must be submitted by August 22, 2007 to the Responsible Official.
