WHEREAS, pursuant to an Interlocal Agreement dated November 15, 1974, Grant County was designated the lead agency to provide, operate, and maintain a County-wide Solid Waste Disposal System; and,

WHEREAS, pursuant to said agreement, Grant County acquired a number of sanitary landfills, other facilities, equipment and supplies, all of which belong to Grant County, in order to establish the Solid Waste Disposal System; and,

WHEREAS, the funds required to operate the Grant County Solid Waste Disposal System should be derived from disposal fees collected from users of the system; and,

WHEREAS, due to the increasing costs for operation of the disposal sites and meeting the requirements of the Washington State Department of Ecology has created a need to increase the disposal fees.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Grant County, Washington, that effective January 1, 2008, the fees for disposal privileges at Grant County operated Solid Waste Disposal facilities shall be as shown on EXHIBIT "A" attached.

BE IT FURTHER RESOLVED, that the County reserves the right to refuse to accept any Solid Waste brought to any County disposal facility which is classified as dangerous or hazardous by the Federal Environmental Protection Agency or any wastes brought to a dropbox facility which exceeds the County's handling capability either due to volume or weight.

NOTICE OF APPLICATION TO CONSTRUCT AN AIR POLLUTION SOURCE

The State of Washington Department of Ecology (Ecology) has issued an approval order (No. 07AQ-E223) to REC Solar Grade Silicon (SGS) to expand and upgrade air pollution sources consisting of construction/installation/operation of new silicon production reactors with support and emergency response equipment, and replacement of some air pollution control equipment. The Approval Order is proposed to be amended by the addition of one cooling tower not considered in the original approval. The application has been made by REC Solar Grade Silicon, LLC for their facility located at 3322 County Road "N" N.E., near Moses Lake, WA in Grant County.

After review of the completed Notice of Construction application and other information on file with the agency, Ecology has made a preliminary determination that this proposal will conform to call requirements as specified in Ch. 173-400 WAC and Ch 173-460 WAC. Copies of the Preliminary Determination and other pertinent information are available for public review at Ecology, 4601 N. Monroe, Spokane, WA, 99205 and at the Grant County Planning Department, 32 C Street, Ephrata, WA.

Grant County Planning Department, as State Environmental Policy Act lead agency for this project, under Ch. 197-11 WAC, has determined that it will not have a probable significant adverse impact on the environment. The department has issued a MITIGATED DETERMINATION OF NONSIGNIFICANCE (MDNS) for the project. Copies of the MDNS and Environmental Checklist are available at no charge from Ecology at the above Spokane address. Moses Lake-The Grant County Mosquito Control District #1 is continuing with its annual mosquito control services. The biological products Altosid A.L.L. and Bacillus thuringiensis israelensis (b.t.i.) Are being used this year in the aerial larviciding program. These products are applied to swamps or other standing water where mosquito larva are present.

The biological product Bacillus sphaericus or Temephos will be applied to sewer ponds and similar standing water high in organic matter.

Products with the active ingredients naled or synthetic pyrethroid will be used in the night time adulticiding program.

Energy Industrial Park: Vic Jansen submitted an application for a major subdivision and binding site plan on July 9, 2007. Additional required information was submitted on August 3. The application was determined to be complete and ready for review on August 3, 2007. The proposal is to divide 60 acres into 12 parcels for future industrial development north of Wheeler Road and west of Road N. No development is proposed at this time. The site is legally described as a portion of Farm Unit 79, Block 41, in the south 1/2 S17-T-19N-R29E and is located in the Heavy Industrial Zone. The project has been determined to be consistent with the City's Comprehensive Plan, and the following development regulations are applicable to the project: Moses Lake Municipal Code (MLMC) Title 14: Environmental Regulations, Title 17: Subdivisions, Title 18: Zoning, and Title 20: Development Review Process.

The Planning Commission will conduct a public hearing on Sept. 13, 2007 at 7:00 p.m. in the City Council Chambers located at 401 Balsam Street. All interested persons are encouraged to attend and provide comment.

Written comments on the environmental impacts of this proposal will be accepted until 5:00 p.m. on Aug. 22, 2007. Written comments on other aspects of this proposal will be accepted until 5:00 p.m. on the date of the public hearing. Persons who want to be informed of future actions, or the final decision, on this proposal should provide their name and address to the project planner. The final decision on this proposal will be made within 120 days of the date of the notice of completeness and may be appealed according to the City appeal provisions specified in MLMC 20.11, Appeals.
