NOTICE OF APPLICATION FOR CHANGE OF GROUNDWATER

PERMIT G3-29072

TAKE NOTICE:

The Port of Mattawa Port District Number Three of Grant County Washington has made APPLICATION FOR CHANGE of place of use for Groundwater Permit number G3-29072 to the Board. The board has designated such application for active Board review assigning it a number of GRAN-06-002. The Department of Ecology has assigned tracking number CG3-29072@4 to this application.

That Ground Water Permit G3-29072, with a priority date of September 26, 1991, has current authorization for 2250 gallons per minute, 1200 acre-feet per year, for continuous commercial supply, industrial supply, and fire protection as needed. The place of use being the land owned by the Port District Number Three of Grant County (Port of Mattawa) consisting of parcels:

Parcel One: A portion of the NE1/4 of the SE1/4 in Section 34, Township 15 North, Range 23 EWM described as follows: Beginning at the East quarter corner of said Section; hence South 89° 15'57" West 1,315.5 feet; thence South 02°36'33" East 895.97 feet to the true point beginning; thence continuing South 02°36'33" East 447.99 feet; thence North 89°13'10" East 1,261.28 feet; thence North 02°25'48" West 447.60 feet; thence South 89°14'06" West 1,262.69 feet to the true point of beginning.

Parcel Two: All that portion of the SE1/4SE1/4 of Section 34, Township 15 North, Range 23 EWM.

Parcel Three: A portion of the the NW1/4 of Section 27, Township 15 North Range 23 EWM, lying West of State Highway 243 more fully described as follows: Beginning at a point where the westerly right of way line of State Highway 243 and northerly bounday of the Northwest quarter of Section 27 intersect, being the true point of beginning; thence westerly along the northerly boundary of the Northwest quarter a distance of 1,830.00 feet; thence southerly along a line parallel to the westerly boundary of the Northwest Quarter to a point 60.00 feet North of the southerly boundary of the Northwest Quarter; thence easterly along a line parallel to the southerly boundary of the northwest Quarter (and 60 feet) North there from to a point of intersection with the westerly right-of-way line of State Highway 24.3; thence northerly along the westerly right-of-way line of State Highway 243 to the true point of beginning and the terminus of this description.

Plus the lands within the platted Urban Growth Area of the Town of Mattawa, Washington, dated August 25th, 1977, described as follows: The NW1/4, W1/4, NE1/4, and N1/4NE1/4 parcels of Section 1; plus all except the SE1/4 of Section 2; plus the E1/4 and the N1/4 of Section 3; plus NE1/4NE1/4 of Section 4; plus the E1/2NE1/4 of Section 10; plus the N1/2NW1/4 of section 11 all within Township 14 North, Range 23 EWM. Plus the E1/2SE1/4 of Section 33; plus the SE1/4SE1/4 and parcel one above in Section 34; plus all south of the USBR water waste way channel in Section 35; plus the S1/4S1/2 of Section 36 Township 15 North, Range 23 EWM.

The proposed change is to add to the current place of use described above the following property; parcels #4-Lot 1&2, Block #2 Pat Chee Subdivision, plus lands within the platted and future urban growth area. That is located in UGA of Town of Mattawa and covered by change of area of use issued in 2001: Parcel #5-That portion of the south 1/2 Section Lying West of State Route 243, Section 27, TWN 15 N RGE 23 EWM, Grant County, Washington. Tax lot # Lot # 15-0195-000.

Any interested party may submit comments, objections, and other information to the board regarding this application. The comments and information may be submitted in writing or verbally at any public meeting of the Board held to discuss or decide on the application. Additionally, the Water Conservancy Board will consider written comments or information provided within thirty (30) days from the last date of publication of this notice, said written comments or information to be provided to its office located at 3953 Airway Dr. NE, Moses Lake, WA 98837.

Any protests or objections to the approval of this application may be filed with the Department of Ecology and must include a detailed statement of the basis for objections. Protests must be accompanied by a ($50) recording fee and filed with the Department of Ecology, Eastern Regional Office, 4601 North Monroe Street, Spokane, WA 99205 within thirty (30) days from October 9, 2006.

NOTICE OF INDUSTRIAL WASTE DISCHARGE PERMIT APPLICATION AND PROPOSED RENEWAL OF PERMIT NO. ST-5292

TAKE NOTICE:

Columbia Foods, Inc., located near Winchester (Grant Co.) and along State Highway 28, has applied for the renewal of State Waste Discharge Permit No. ST-5292, according to the provisions of Chapter 90.48 RCW and Chapter 173-216 WAC. The permit will allow the discharge of vegetable process wastewater onto land via spray irrigation. The maximum daily discharge from the processing facility is approximately 1.25 million gallons per day, and an average monthly flow of 559,000 gallons per day. The sprayfields (approx. 235 acres) are located within USBR Farm Unit 18 and 19, Block 72; Section 8 and 9, T. 20N, R. 25 E.W.M. The amount of wastewater used for irrigation is dependent upon the crop needs as explained in a submitted engineering report.

Interested agencies, organizations or persons desiring to express their views or to be notified of the Department's action on this application and subsequent permit should notify, in writing: Water Quality Permit Coordinator, Department of Ecology, 4601 N. Monroe St., Spokane, WA 99205, of their interest within thirty (30) days of the last date of publication of this notice. Please bring this information to the attention of persons you know would be interested in this matter.

Mr. and Mrs. Steve Noah of Soap Lake has made an APPLICATION FOR CHANGE/TRANSFER of Water Right to change the points of withdrawal and transfer the place of use for a portion of Groundwater Certificate G3-00635C to the Board. The board has designated such application for active Board review assigning it a number of GRAN- 06-004. The Department of Ecology has assigned tracking number CG3-00635C to this application.

That Ground Water Certificate with a priority date of May 27, 1971 has current authorization for 1500 gallons per minute, 662 acre-feet, from April 1 to October 31, each year, for the irrigation of 150 acres, and as needed for fire protection. The place of use being the SE1/4 of Section 4, T. 21N., R. 27E., W.M. Grant County tax parcel numbers 161757000. The points of withdrawal being two wells both located within the NW1/4SE1/4 Section 4, T. 21 N., R. 27 E., W.M.

The proposed change is to transfer the place of use and points of diversion of 1150 gallons per minute, 507.50 acre feet, from April 1 to October 31, each year, for the irrigation of 115.0 acres in the SW1/4 of Section 34, T19 N., R. 25E., W.M. Grant County tax parcel number 151857000. The new points of withdrawal being two wells located within the SW1/4S1/4 and the NE1/4SW1/4 of Section 34, T. 19 N, R. 25 E, W.M.
