NOTICE OF MITIGATED

DETERMINATION OF

NON-SIGNIFICANCE

NOTICE IS HEREBY GIVEN that the City of Moses Lake issued Mitigated Determinations of Non-Significance (MDNSs) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following projects:

1. Hardy Major Plat - Subdivide 7.38 acres of land into two lots in the Heavy Industrial Zone. The proponent is Merle Hardy, Moses Lake. The site is legally described as Tax # 10,775 and 10,793, and is located 685' south of the intersection of Road N and Wheeler Road.

2. Bernhardt Major Plat - Subdivide 4.56 acres of land into 14 residential lots in the R-3, Multi- family Residential Zone. The proponent is Bill Bernhardt, Moses Lake. The site is legally described as a portion of Lot 8, Battery Orchard Tracts; a portion of Lot 45, Terminal Park Addition; and portions of Tax #3335, 3533, and 3534 in N1/2N1/2 S27-T19N-R28E. The site is located south of the intersection of Milwaukee Avenue and Lakeside Drive, and northeast of the railroad right-of-way.

After review of the completed environmental checklists and other information on file with the City of Moses Lake, the SEPA Responsible Official has determined that the proposals will not have a probable adverse impact on the environment if the stipulated mitigation is provided. Pursuant to WAC 197-11-340(2) the lead agency will not act on these proposals for 14 days from the date of determination. Comments on the MDNSs must be submitted by June 28, 2006 to the Responsible Official.
