NOTICE OF APPLICATION FOR CHANGE OF GROUNDWATER

PERMIT G3-29201P

TAKE NOTICE:

Mr. Gerald Brown of Royal City has made an APPLICATION FOR CHANGE/TRANSFER of Water Right to change the place of use and the points of withdrawl of Groundwater Permit G3-29201 to the Board. The board has designated such application for active Board review and has assigned number GRAN-05-005 to this application. The Department of Ecology has assigned their tracking number CG3-29201@3.

That Ground Water Permit G3-29201P with a priority date of May 26, 1992 has current authorization for 6300 gallons per minute, 2880 acre-feet per year, for seasonal irrigation of 960 acres within: All of Section 12; the N1/2 of Section 13, lying northerly of the W61C Canal; Both in T17N, R23E, W.M., AND SW1/4 of Section 6, T17N, R23E, W.M. The authorized points of withdrawl are 5 wells located: 1) 10 ft. west from the E1/4 Corner, within the SE1/4SE1/4NE1/4 and/or NE1/4NE1/4SE1/4; 2) Center of the SW1/4; 3) Center of the SE1/4; 4) 1320 feet north of the S1/4 Corner, within the W1/2W1/2SE1/4 and/or E1/2E1/2SW1/4; and 5) Center of the SE1/4SE1/4; ALL IN Section 27, T17N, R23E, W.M.

The proposed new place of use is 960 acres within: All of Section 12; the N1/2 of Section 13, lying northerly of the W61C Canal; Both in T17N, R23E, W.M.; AND the W1/2 of the SW1/4 of Section 6, T17N, R23E, W.M.; AND that portion of the NE1/4 of Section 27 and W1/2 of the NW1/4 of Section 26 all in T17N, R23E, W.M. lying within the existing 1565 foot radius wet area circle covering 163 degree arc, an area of 80 acres plus or minus.

The proposed new points of withdrawl are 5 existing wells and a proposed well located: 1) SE1/4NW1/4, 2) NW1/4SW1/4 6) NW1/4SW1/4, 7) NW1/4NE1/4, 8) NW1/4NW1/4 ALL within Section 27, T17N, R23E, W.M.; and NW1/4NE1/4 Section 15, T17N, R23E, W.M.

There is no change to the authorized amount of water or its use.

Any interested party may submit comments, objections, and other information to the board regarding this application. The comments and information may be submitted in writing or verbally at any public meeting of the board held to discuss or decide on the application. Additionally, the Water Conservancy Board will consider written comments or information provided within thirty (30) days from the last date of publication of this notice, said written comments or information to be provided to its office located at 1030 East Broadway Street, Moses Lake, WA 98837.

Any protests or objections to the approval of this application may be filed with the Department of Ecology and must include a detailed statement of the basis for objections. Protests must be accompanied by a fifty dollar ($50.00) recording fee and filed with the Department of Ecology, Eastern Regional Office, 4601 North Monroe Street, Spokane, WA 99205within thirty (30) days from October 25, 2005.
