NOTICE OF MITIGATED DETERMINATION OF NON-SIGNIFICANCE

NOTICE IS HEREBY GIVEN that the City of Moses Lake issued a Mitigated Determination of Non-Significance (MDNS) under the State Environmental Policy Act Rules (Chapter 197-11 WAC) for the following project:

Power Pointe Major Plat I, II, and III-Subdivide 27 acres into 99 single family residential lots in the R-1, Single-Family Residential Zone with associated street and utility construction. Portions of the site abut a Category III Wetland and are within 200' of the ordinary high water mark. None of the proposed lots will front the lake. The proponent is Smart Homes, Inc. and the site is located north of Montlake Park at the northeast intersection of Linden Avenue and Beaumont Drive and east of the railroad ROW in S27, T19N, R28E..

After review of the completed environmental checklist and other information on file with the City of Moses Lake, the SEPA Responsible Official has determined this proposal will not have a probable adverse impact on the environment if the stipulated mitigation is provided. Pursuant to WAC 197-11-340(2) the lead agency will not act on this proposal for 14 days from the date of determination. Comments on the MDNS must be submitted by October 26, 2005 to the Responsible Official.
