NOTICE TO ALL INDIVIDUALS ACCUSED OF A FELONY CRIME IN GRANT COUNTY SUPERIOR COURT WHO ARE REPRESENTED BY A PUBLIC DEFENDER

This case is a class action lawsuit challenging the constitutionality of Grant County's felony public defense system. A proposed settlement has been reached. Under the terms of the proposed settlement, Grant County will comply with certain public defense standards under the oversight of a monitor appointed by the parties. Grant County will also pay a portion of the plaintiffs' attorneys fees, and may pay additional fees in the future if the County fails to comply with the terms of the proposed settlement agreement.

A hearing on the proposed settlement will be held on December 22, 2005, at 9:30 a.m., before Judge Michael Cooper in the Kittitas County Superior Courthouse in Ellensburg, Washington. At the hearing, Judge Cooper will decide whether or not to approve the settlement. Copies of the proposed settlement have been posted at the Grant County Superior Courthouse Grant County Jail. A copy may also be obtained from the case file at the Kittitas County Superior Courthouse during regular business hours. Written objections must be mailed to the Clerk of Kittitas County Superior Court at: Ofiice of the Clerk, Kittitas County Superior Court, 205 W. 5th Ave. Suite 210, Ellensburg, WA 98926. The objections must be mailed by no later than December 19, 2005.
