You are hereby summoned to appear within sixty days after the date of the first publication of this summons, to wit, within sixty days after the 14th day of July, 2005, and defend the above entitled action in the above entitled court, and answer the complaint of the Plaintiff, Michael S. Smith, and serve a copy of your answer upon the undersigned attorney for Plaintiff, TED W. VANDEN BOSCH, at his office below stated, and in case of your failure to do so, judgment will be rendered against you according to the demand of the complaint, which has been filed with the clerk of said court.

The object of the action concerns the forfeiture of earnest monies deposited pursuant to that certain Residential Real Estate Purchase and Sale Agreement dated April 1, 2002.

NOTICE OF APPLICATION

and SEPA DETERMINATION

Notice is hereby given that the Grant County Planning Department has received and found the following land use application to be technically complete as of July 1, 2005 and ready for processing, public review and comment. The Grant County Planning Department has issued a SEPA Determination of Non-Significance regarding this proposal.

A Unified Development Code amendment to the

front yard (road side) building setback. The

amendment is an application to change the front

setback from 20-feet to 2-feet in the development

known as the Rimrock Cove Division No. 1 in

the Shoreline Development-3 zone located in a

portion of Section 29 Township 24 N Range

27 E, WM. Grant County WA.

The above land use application shall be considered before the Grant County Planning Commission at an open record public hearing at 7 p.m. on September 7, 2005 in the Commissioner's Hearing Room in the Grant County Courthouse. Copies of the application and SEPA materials (File #05-4084) in the above proposed land use action are available from the Grant County Planning Department, 32 C St. NW, Room 26a, PO Box 37, Ephrata WA 98823, (509) 754-2011 extension 625. Comments on the proposed UCD Amendment and SEPA Determination must be submitted no later than 5 p.m. August 10, 2005, to Dorothy Black the project planner at the above address. All comments should be as specific as possible and may be mailed, personally delivered or sent by facsimile. Any person has the right to comment, receive notice, participate in any hearings, request a copy of the final decision, and appeal the decision as provided by law.
