TO ALL INTERESTED AGENCIES, GROUPS, AND PERSONS:

On or about April 14, 2005, the above-named City will request the State of Washington Department of Community, Trade and Economic Development (CTED) to release federal funds under Title I of the Housing and Community Development act of 1974 (PL 93-383) for the following project:

Drill new well # 7, rehabilitate existing wells 2,5 & 6 and decommission wells 3 & 4.

ENVIRONMENTAL REVIEW RECORD

An Environmental Review Record (ERR) for this project has been developed by the above-named city. The ERR documents the environmental review for this project and contains all of the required SEPA, NEPA, Section 106 Review and Endangered Species Act information. This Environmental Review Record is on file at the above address and is available for public examination and copying upon request at City Hall (201 South Ash Street, Warden, WA. 98857) between the hours of 9:00 am and 5:00 pm.

RELEASE OF GRANT FUNDS

The City of Warden will undertake the project described above with Community Development Block Grant (CDBG) funds from CTED under Title I of the Housing and Community Development Act of 1974. The City of warden is certifying to CTED that the City of Warden and Roldan L. Capetillo, in his official capacity as Mayor consents to accept the jurisdiction of the federal courts if an action is brought to enforce responsibilities in relation to the environmental reviews, decision making and action, and that these responsibilities have been satisfied. The legal effect of the certification is that upon its approval the City of Warden may use the CDBG funds and CTED will have satisfied its responsibilities under the National Environmental Policy Act of 1969.CTED will accept an objection to its approval only if it is on one of the following bases: a) that the certification was not in fact executed by the chief administrative official or other officer of the applicant approved by CTED; or b) that the applicant's Environmental Review Record for the project indicates omission of a required decision finding or step applicable to the project in the environmental review process.

Objections must be prepared and submitted in accordance with the required procedure (24 CFR Part 58) and may be addressed to CDBG Program Manager, CTED at 906 Columbia Street SW, PO Box 42525, Olympia, Washington 98504-2525.

Objections to the release of funds on bases other than those stated above will not be considered by CTED. No objection received after April 29, 2005 will be considered by CTED.
