NOTICE OF TRUSTEE'S SALE

NOTICE IS HEREBY GIVEN that on June 25, 2004, at 11:00 a.m. the office of Catherine L. Dullea, Attorney at Law, as Successor Trustee, 101 N. Fourth Avenue Suite 204, Sandpoint, ID, will sell at public auction to the highest bidder, for cash in lawful money of the United States of America, all payable at the time of sale, the following real property situated in the County of Bonner, State of Idaho, described as follows:

A tract of land in Government Lot 1 of Section 28, Township 57 North, Range 1 East, Boise Meridian, Bonner County, Idaho, more particularly described as follows: to-wit:

Beginning at the intersection of the East line of Section 28 with the old County Road, being a point 235 feet North along the Section line from the North right of way line of the Northern Pacific Railway; thence along the center line of the said County Road North 55o21' West, 87.2 feet; thence North 29o04' West 138.3 feet; thence North 18o27' West, 76.7 feet; thence North 29o06' West, 49.6 feet; thence along a stream of water and 4 feet East thereof, South 58o14' West 14.3 feet to a 1" pipe, and continuing 49.6 feet; thence South 30o42' West 71.8 feet; thence South 28o45' West to the North right of way line of N.P. Railway; thence Easterly along the said right of way line to the intersection with East line of Section 28; thence North along said section line for 235 feet to the center of County Road, the place of beginning;

EXCEPT A TRACT more particularly described as follows, to-wit:

Beginning at a 1 inch pipe in the center line of the old County Road, accepted by the Grantor to be a point on the section line between Sections 27 and 28, Township 57 North, Range 1 East of the Boise Meridian, said 1 inch pipe being North 2339.48 feet and West 2755.86 feet from a 2 inch pipe found and accepted as the Southwest corner of Government Lot 2 of Section 27; thence along said County Road center line North 35o13' West 51.85 feet; thence North 57o45' West 59.64 feet; thence North 41o03' West, 10.11 feet to the True Point of Beginning of this tract and this description; thence continuing along said road center line the following 4 courses: North 41o03' West, 39.72 feet; thence North 29o36' West, 92.71 feet; thence North 18o13' West, 95.87 feet; thence North 28o37' West, 64.62 feet to a point Southeasterly 4.00 feet from the Southeasterly band of a small stream; thence parallel to and 4.00 feet distance from said stream bank generally following the next three courses: South 54o22' West 76.45 feet; thence South 26o54' West 71.15 feet; thence South 26o20' West to the Northeasterly right of way of the Northern Pacific Railway; thence Southeasterly along said railway right of way to a point South 57o21' West from the true point of beginning; thence North 57o21' East to the true point of beginning.

ALSO EXCEPT A TRACT described as follows:

Commencing at the intersection of the East line of said Section 28, with the center line of the "Old" County Road, said intersection being a 1 1/2" iron pipe; thence South along said East line 140.11 feet to the True Point of Beginning; thence continuing South along said East line 118.20 feet more or less to the Northeasterly right of way of State Highway 200; thence Northwesterly along said right of way 89.00 feet more or less to a point that bears South 48o50' West, 78.33 feet from the true Point of Beginning; thence North 48o50' East, 78.33 feet to the True Point of Beginning.

ALSO EXCEPT highway right of way.

Said sale will be made, without covenant or warranty regarding title, possession or encumbrances, to satisfy the obligations secured by and pursuant to the power of sale conferred in the Deed of Trust executed by JEFFREY S. SMITH, an unmarried man, as Grantor to First American Title Company, as Trustee, and said Trustee having resigned and the Beneficiary having appointed Catherine L. Dullea, Attorney at Law, as Successor Trustee, for the benefit and security of SANDRA J. WRUCK, an unmarried woman, as Beneficiary, said Deed of Trust having been recorded on October 13, 2000, as Instrument No. 571373, official records of Bonner County, Idaho.

THE ABOVE GRANTOR IS NAMED TO COMPLY WITH S45-1506(4)(a) IDAHO CODE. NO REPRESENTATION IS MADE THAT HE IS, OR IS NOT, PRESENTLY RESPONSIBLE FOR THIS OBLIGATION.

The default for which the sale is to be made is the failure of the Grantors and/or assumptive Grantor(s) to monthly payments of $949.45, each, for the months of November, December, 2003, January and February, 2004, failure to pay late fees of $94.95, each for the months of November, December, 2003,and January, 2004, failure to pay default and attorney fees of $200.00, and failure to pay property insurance, which the Beneficiary purchased in the amount of $1,278.00, and failure to pay the 2001, 2002 and first half of the 2003 real property taxes.

The balance owing as of the date hereof on the obligation secured by said Deed of Trust is the amount of $108,820.56, plus accrued interest at the rate of 9.0% per annum from October 12, 2003, plus any other costs or expenses associated with this obligation or foreclosure as provided
